TLDR : Answer Summary
The original poster inquires about the validity of their work permit (WP) expiring on December 11, 2020, and whether it's acceptable to hold a visa in their passport post-expiration. Several users clarify that while the visa may remain valid, the work permit's expiration necessitates its cancellation to avoid complications with immigration status. Users emphasize the importance of informing the Immigration Office of any employment changes and the need for proper documentation from the employer for cancellation procedures.

I hope it’s ok that I comment here as well (otherwise please delete my comment and I will Post it new 🙏🏼) as I have a very similar situation. My WP expires on a Sunday 06 Dec. Is it ok to cancel it myself on Monday morning 07 Dec?

What kind of letter is required from the employer to be able to do ist myself?

For cancelling the Visa Extension at CW, does it need to be done on 7 Dec as well or could I do to it on the 8 Dec in the early morning to get a queue at CW, as I would also need to apply for a 60 Day Covid Extension at the same time.

You can go in advance and cancel the documents on the last day or you go in your case on Monday morning.

The letter needed is a letter that states that you do not work for that company anymore, that could be written by the company as end of contract or fired with reason or I guit this job on day ../../..

Thanks a lot for the Information. 🙏🏼

In case I cancel my work permit on Friday afternoon after I finished working. Do you think it’s still in order, If I cancel my Extension of stay at CW on Monday Morning? I tried to find the Option to make an online appointment to cancel my Extension of stay, but couldn‘t find that Option for an appointment at CW.

I‘m just afraid that I can’t handle everything on one day, as I wanna be early at CW to be able to apply for the 60 Days Covid Extension as well.

First of all why you think your employer does everything for you.

As it is YOUR Work Permit, you have to make sure it get cancelled at the Ministry of Labor, the same office where you signed this blue booklet and collected it, it has to be canceled on the last day of working.

You also have to visit the Immigration Office as you signed that you will inform the Immigration Office when there are changes in the requirements based to get this Extension of Stay permitted up to 23 Feb 2021.

You stop working and you hand in your Work Permit, these are major changes, so you have to inform Immigration and cancel this Extension of Stay on the last day of working.

i agree... the one point that i think bears a bit more clarity is that a WP can in fact be cancelled by EITHER the employer or the employer without the other party being present. My experience is that most “reputable” employers (who commonly have either a handful or more of foreign staff presently employed or are experienced with DoE labour rules) will either handle this for the employee or will give them employer the papers necessary for DIY. The only part of the cancellation issue that remind foreigners about is that the penalties for not canceling a permit falls only to the employEE and not the employER.

I wholly agree that the extension (ie immigration matters) falls solely to the foreigner and the employer can’t process anything on your behalf - without you being both present and the original passport in hand.

Employers are fined if the WP does not get cancelled within 15 days after the employee stops working. But why talk about fines for things not done?

Get your ducks in a row, every one signed they understand the rules of working in Thailand. Follow the rules, it makes live easy.

“... But why talk about fines for things not done?”. ==> I like to know what could happen if I were to do X, Y or Z... for me it’s just a way to making an early assessment as what i might want to do and the associated risk/reward.

“... Follow the rules, it makes live easy.”. ==> I agree.. but i also must recognize that at time the system in thailand does not always make it easy to follow that axiom.

appreciate your constructive commentary.

If you look in the passport, you should have a large stamp that says "extension of stay". The extension of stay is cancelled when the work permit is cancelled.

If you have a large, full page sticker that says "Non -B multiple entry visa", that does not get cancelled when the work permit is cancelled
