What happens to my non-B visa extension if my work permit expires in Thailand?

Hi knowledgeable visa people!

I need your help to find out the truth about my future.

I have a WP valid until the 14th of October. Sadly however it won’t get renewed. My non-B - or to be more precise the extension of stay of my non-B - is valid until the 3rd or Feb 2021.

I have heard very contradictory info; that my non-B will automatically get cancelled when my WP expires, that I need to cancel the non-B myself, that I have one week post WP expiration date to leave Thailand or that I can remain in Thailand until Feb 2021 as long as I don’t work.

Can someone please please help me figure out what’s the deal?! Thank you so much!

TLDR : Answer Summary
The expiry of your work permit (WP) affects your non-B extension of stay. Since your non-B visa is tied to your employment, once your WP expires, you can no longer meet the conditions of your non-B extension. Therefore, it automatically becomes invalid, and you may be required to leave Thailand if you do not have an alternative visa arrangement. It's advisable to consult your local immigration office for specific guidance on your situation.

Seems like you might do some enquiry with your local immigration office as to whether they would renew your extension without leaving Thailand or sell you a new non B visa if you found another job.

I would be very careful because both of them should run together.

what do you mean?!

Your Work permit and Non-B should run to the same valid date. The issue you will have is that late on when replying for a new Non- B there is no evidence of you canceling your work permit and visa. When the work permit expires so does the visa. I had an issue a few years back and left the country to obtain a new Non-B but I never told the immigration ( in which I didn't know the new rule) I got the Non- B outside the country but the problem arose when I went to extend the visa inside the Kingdom because of the work permit. Thankfully they gave me grace.

My advice is to go into immigration and inquiry. I am not sure where you are? But Bangkok immigration is very helpful

Your WP is one of the requirements of your extension based on employment. When you lose one of the requirements, means you don't meet the criteria any more, your extension of stay gets invalid. Then you would be on overstay...

makes perfect sense, thanks for the explanation

You applied for an Extension of Stay and got permission to be inside Thailand as long as you work but with latest date 3rd Feb 2021, If you stop work, you cancel this permission to be inside Thailand and you apply for a new Extension of Stay, if you can not meet any reasons for a new Extension, you have to leave the country

thank you so much, really helpful. On which grounds could I get a new extension? With a new employer only i guess?

Also, is the leaving the country immediate?

On which ground, just some ideas,

being over 50 year of age

having half Thai children

being married with Thai citizen

witness in a court case

and so on,

Yes, you might fall under the amnesty and get until 26 September or otherwise get a new application denied and 7 day to leave the country,
