Is it necessary to pay 1,600 baht for a TM30 filing due to a previous landlord's negligence?

Question: I need to file a TM30 for my new apartment in Pattaya, which I rented for a month, so that I can later do my 90-day report. My previous accommodation here did not file a TM30 for me.

Now, the agent for my new apartment says that since there is no TM30 for my previous Pattaya apartment, the apartment owner needs 1,600 baht to file it now for my current residence. Supposedly, this may be to prevent immigration from asking questions about the missing TM30 from before but I'm not sure.

Is this a scam or standard practice? Does immigration really check this and require a full TM30 history for the entire stay to file a tm30 in Pattaya? What do you think I should do in this situation?

TLDR : Answer Summary
The post discusses the requirement of filing a TM30 report in Pattaya after moving to a new apartment and the claim from the new landlord's agent that a fee of 1,600 baht is required because the previous landlord did not file a TM30 for the prior accommodation. Several comments suggest this fee is a scam, emphasizing that it is the landlord's responsibility to report TM30s, and that immigration only requires the most recent TM30, not a history of previous ones. Recommendations include going directly to immigration to handle the TM30 personally.

Scam. What is 1600thb supposed to cover? Go to a hotel for 1 night and get a tm30 if they want a history before the LL does a new tm30. Some people are so greedy!

It’s landlords duty to report and file TM30 on your behalf. If they fail to do so, they need to pay a fine of 1600. But as we all know, this is Thailand. The landlord is trying to make you pay for the fine, because it’s ultimately you who need the TM30 more than the landlord.

On the plus side, if you do not plan to extend your visa, you do not need to file TM30 and 90 Day report. Nobody is coming to knocking on your door asking for your TM30 and 90 Day report. Just leave after 180 days and enter again.

Sounds like a scam

Pretty simple, tell him you got the TM 30 for the old department now, so all you need is the new one. You’ll find out.

Sounds like you may be asking them to back date your new one

They’re scamming you 😠 tm30 is their responsibility you should go to immigration to clear yourself

This is not a thing, that agent can't see any TM30s that have or haven't been done.

This is a reason I avoid any agent's.

Tell the agent you will do the TM30 yourself and go to immigration and do it. When at immigration don't mention anything about the missing one.

your current contract, landlord ID etc (everything they should be giving you a copy of when you sign anyway) & your passport. When you go to immigration, they’ll confirm you have all your documents before you even get a queue number

what do I need to do a tm30?

First thing your previous landlord must report TM30 within 24 hours of your arrival, it’s their responsibility. Failure to report within the 24-hour window can result in fines for the landlord and yes you may face difficulty getting your visa extended if your TM30 record isn't up to date and have to pay the fine up to 1,600 THB to the officer.

For your current apartment if it’s different landlord, different place, it has nothing to do with them they just have to report within 24 hours the same otherwise you will face the same problem. Make sure to request the proof of TM30 report within 24 hours after your move in.

but the current landlord hasn't reported it within 24h. It's been about a week since I moved in. So maybe that's the reason they're asking the 1600 baht?

Anonymous participant the landlord is getting a fine from immagration for late report and he is trying to get you to pay for him. Just leave and get another tm30 straight away

but I signed a contract. How can I leave?
David ********
Anonymous participant He has breached the contract. What's he doing to do

Anonymous participant They can report you moved in tomorrow. I doubt very much immigration is going to check against the lease agreement. This new landlord and agent are having you on.

Anonymous participant it’s their responsibility to report. Did they provide a valid reason why they didn’t do that?

you can also call immigration officer to consult your case or/just ask for clarification about the fine. This phone number you can find on immigration website.

You can get a tm30 from a hotel if you stay 1 day

Yep scam
Wannikea *********
Total scam, immigration is only concerned about the most recent TM30. I advise you to stop doing past history storytime with landlords and just request the TM30 they are required to file

Wise advice ✅

I think they are trying it on. It would not be your new landlord having to pay 1600 for not registering but the previous one who did not.
