I am working in Thailand and my extension of stay is based on my employer. However, I was thinking about changing my extension to a an extension of stay based on marriage and still maintain my job.

Is this transition allowed and would it cause any issues with my current employer or WP registration?

Would I need to meet the 400k THB seasoning requirements or could I just show my pay verification?

TLDR : Answer Summary
The user wishes to change their extension of stay from employment-based to a marriage-based visa while continuing to work in Thailand. To make this transition, it is important to note that a B work visa cannot be extended based on marriage; rather, it must be converted to an O marriage visa. While the user can use their salary as proof of financial stability, they must meet specific requirements: a minimum income of 40,000 THB per month or a bank balance of 400,000 THB in their name for two months. Additionally, their employer may need to provide a letter of consent and possibly documentation proving income. It is advisable to consult with the local immigration office for detailed requirements before proceeding.

just go to your local immigration and ask

You need to convert your visa from a B work visa to an O marriage visa. You cannot extend a B visa by reason of marriage.

He want to change the reason for Extension of Stay.

Not convert one visa into another

@Robert ******
That is not going to work. Certain visas have certain extension qualifications. They need to match.

The first line of the O/P's post is what means he CAN change the reason for an extension of stay

That leads me to believe they are NOT on a Non-B 90 visa but an extension and there is no problem cancelling the extension based on employment and immediately applying for a new extension based on marriage to a thai if he meets the requirements

not necessarily. A person can change the reason for their extension of stay, without having it tied back to the "original visa". A person can get a one year extension of stay based on marriage IF they already received a one year extension of stay based on employment. A person can also hold a work permit on this extension of stay.

Work Permit is tight to the job and is from the Ministry of Labor.

Your Extension of Stay is from the Immigration Office, two different things.

You can change the reason for a new Extension of Stay into based on marriage but you need to meet the financial requirements;

OR 2 months 400.000 Thb on a Thai bank account on your name or a minimum income of 40.000 Thb a month.

If this income is made in Thailand proof of SSO and Tax payments from you and 4 Thai staff are needed over the last 3 months before application.

I meet everything but HR seems like they donโ€™t want to help or care so I will just let it be. Thanks.

As for extension-wise, changing the reason from employment to marriage to a Thai is not a problem. You can use your salary income as proof of your funds. Being an extension based on marriage to a Thai is no problem for you to keep your work permit.

But, how it would go depends on your employer. You may need the letter from your employer saying agree to change the reason. You also may need some documents from your employer to prove your income, just showing your payslip may not be enough.

You better go to your local immigration office to get a handout of requirements for a 1-year extension based on marriage to a Thai first. Then check what you need, and talk with your employer to be sure they and you don't have any problem to change.

You may be able to change the reason for an extension that is one of the requirements for WP to apply for change for WP. But it also depends on the timing.. You need to check your local labor office for detail.

If it'd be me, I would talk with your employer, have them talk with the Labor Office and the Immigration office for the detailed process, then follow the direction.

IMHO, it would be best you change the reason for an extension at the time of the next new application of extension along with your WP unless you have a specific cause you want to change the reason for an extension before that.

yeah I did speak with my employer. My extension renewal is February. My employer seems unhelpful about it and not interested.

my work is saying the WP is tied to my current extension and would need to be cancelled if I switch extension of stay reasons. Is this right?
