Can I switch my visa extension from employment to marriage without quitting my job in Thailand?

Hi everyone, I need some help.. About switching my extension based of employment to extension based on marriage. (I’m married to a Thai Nationality) due to my workplace still remain close, and I wish to keep my work permit just in case they’re reopening soon.🤞🏼 I just went back from Samui Immigration this morning. They informed me that I can change the reason to extension based on marriage but I have to quit my job. Is this a must? Or it’s depending on the officer?

yes, I’m married legally on 2018. By that time, I was with Non-O based on marriage. And then I found a job. My company asked me to apply the Non-B visa by returning my home country (by that time I didn’t know married a Thai is legally to work).

I hold my Non-B visa with extension based on employment until now.

But this year, there are some issues to renew my extension based on employment. Documents are not complete,etc. Since my company remain close.

getting a one year extension of stay based on marriage to a male Thai national is the easiest extension of stay to acquire since it doesn’t have any income requirements. You should be able to get PR/ Citizenship as well easily.

I don’t know why the immigration office is telling you to quit your job though.

yes. This page helped me a lot. Before this, one of the staff pass me this paper and telling me this is the document needed.

She said that, “please prepare all this paper, but it’s also depending on the officer to approve it or not”.

I was like ❓

I prepared it all and presented myself in the morning. But the officer said, since you still a employee you need to stick with this reason of employment instead of change it to marriage. If you wanted to change it to marriage, I wanted the resignation letter from your company.

If OP wants to change the reason for extension right now - means not when a new year extension application, she has to cancel the current extension and apply a new one, this cancellation might cause kinda problem while she can surely hold work permit with extension based on being married to a Thai national.

As others mentioned above, OP may want to wait until when the current extension expiration.

You mean they want me to wait until my due date? They are 30days under consideration, am I need to apply it on 26 OCT? But anyway by that time I guess they still want the resignation letter from my company by changing this reason. I double check with them is resignation letter? Not the letter about canceling my extension based on employment..

sorry, but just need to make sure one point.. Are you on an under-consideration stamp now after you already did apply for a one-year extension recently?

Or you are on a one-year extension and you are going to apply for new one-year extension in November?

I believe you are confusing what that 30 day under consideration stamp is. It doesn't mean you HAVE to apply 30 days before your current extension expires. You can apply for another extension right up to the last day your current stamp is good for. It's because of the type of extension you're applying for that gives you a 30 day under consideration stamp when you apply. It's actually the first month of the new yearly extension

So if you have an extension that runs out on Nov 26 that's the last day you can apply for a new extension. You don't NEED to do it a month early

Why do you have quit job cos u wanna change reason for stay, I didn’t quit my job when I did that few years ago tho local immigration in my province told me same thing but I just waited till my visa ran out n switch and I had all requirement ready, a month to my visa running out I asked my employer to cancel for me and I switched and for your working permit u can have multiple working permit on marriage visa and I have evidence of that

sorry that is 100% false. You can change the reason for your extension when it comes due from one based on employment to one based on marriage to a thai. AND you can still work/hold a work permit on a married to a thai or raising half thai children extension too

What kind of document you asked from your employer to cancel? Is this cancel means resignation? Or cancel the “extension based on employment” but we still remain employ?

My extension due is on 26 NOV, I wish to get it done earlier also I’m worried if they need more documents required I still have time to prepare. 😅

I asked my employer to cancel my current visa which is non-b at the time, local immigration told me to quit my job but the fact is you have to stop talking too much with this officers cos so many of them barely knows solution to certain circumstances and they just give u advice that can ruin your sanity, I believe

and some pple here will help you more but straight from experience I didn’t quit my job. From now till 2 week of October make sure get all your documents and requirements ready and satisfied where needed, tell your employer that’s if you are on non-b to cancel this visa for you and immigration gonna give temporary extension till they consider your marriage extension. That doesn’t affect your work and current working permit at all, just letting you know marriage visa can work and have multiple working permit from different employer as long as your job don’t clash or working permit on personal business

Do not switch, as that means you cancel your current Extension of Stay to apply for a new Extension of Stay based on another reason.

Wait until your current Extension of Stay is nearly at it end and apply during the last 30 days for a new Extension of Stay using the reason based on marriage to a Thai National.
