Do you need to stay outside Thailand for a specific duration when applying for a WP3 work permit?

Hey Guys

As the applicant needs to be outside Thailand whilst WP3 application is made, can this just be the day of application or does it need to be the 5-6 days whilst being processed, read conflicting reports.

Hi Tod yes that and then in 7 days you get the WP3 letter, my staff checked in Penang just now and he needs both to complete the application, I reposted pic in the chat with Robert, the man at Krabi labour office was very specific that he must remain outside until letter is ready, so all in is approx

I agree with both your arguments here, JD where money can be made they will always find a way and I think the agents probably give as it's just the way it is, but as Robert says if you do it in person with the correct documents/attitude then Krabi Labour is straight forward without the tell tale delays that mean they are expecting something. I have had my WP there 16 years and manage 4 others for my staff, but this is our first new one since the WP3 rules tightened up, I will go in to Labour next week and ask them and update back in here

Walk into the office go to the info desk and say: Hello I like to have a Work Permit, please. Lady will ask, what kind of visa you have. You tell and she gives you the correct application form with a list of papers in Thai and English needed to apply for the Work Permit. Go back home, start the copy machine and tick the box when done, it can not be made more easy than that. Have a good night my friend.

The logical marker is that many companies can NOT provide the correct paperworks and asking agents to pay the way to collect the Visa or the WP. Yes, you are correct using corruption to get what they should not have. But we are not allowed to promote criminal offense on Facebook.

Personally I believe that many typical Visa/WP Agents in Thailand only know one or two ways to get it done. And that is what they do ... never mind that there could be option 3 or 4 ... The Agent got it done last time using the method they used before - etc., etc. So they just keep doing what they are doing - doesn't matter that there could be a better way.

Also - I believe the built in hurdles on the B Visa / WP 'system' has evolved into a overly complicated 'system' that invites corruption in order to get the job done...

Depending on the Ministry of Labor jurisdiction (Province / City) ... it can be up to 7 days out of Thailand. My understanding - the Visa / Work Permit agent submits the WP3 Application form and packet to the Ministry of Labor - After the Visa/WP agent can present a photo of the Applicant's passport with the Thailand Exit stamp and the neighboring country's Entrance Stamp... Then processing begins on the WP3 Application... But obviously this varies quite a bit across Thailand at the various Ministry of Labor offices as evidenced by the posts here.

If the employee picks up his Work Permit, the officer checks if he was abroad, this because to many people abused the system. No visa no problem, we apply with WP 3 give you the paper and of you go to neighbor country and apply Non B visa. WP 3 is an application form for a foreigner who is abroad, not for one who has the wrong Visa or Visa Exempt stamp and is inside Thailand.

My comments are made based on experience at Krabi's Ministry of labor. I did the applications by myself, not usage of Agents and never had to provide exit stamps or entry stamps neighbor countries in the last few years. Before that my Employer applied using the WP 3 for me and I obtained two days later a Non B visa in Singapore, not a neighbor country and I never send copies of stamps.

Examples I have wittnessed in Krabi Labor: 1. a Foreigner smoking a cigarette on the parking lot while his staff applies for the WP using the WP3 forms. All papers went straight into the bin, this is fraud he is on the parking lot outside and not abroad. 2. My friend came back with Non B visa from Penang, check of date stamps, out of Thailand same day as application, fraud she said, he got away by showing pictures of him stuck overnight in Trang due to floodings and no more bus services, explaining that is the reason why he left 1 day later than planned.

If you have a Visa that allows you to work, or living near an Immigration Office that is able to provide that kind of Visa you do not have to leave. WP3 is application for work permit for foreigner abroad or without the correct Visa. Krabi Immigration does not convert Visa, so it means you have to travel.

many many companies don't or can't convert a 30 day visa exempt stamp or a tourist visa to a 90 day Non-B inside the country, and instead send their employees out of the country to a thai consulate to get a single entry 90 day Non-B

I don't really understand this, WP3 is the normal work permit? You need to be outside to apply for the visa sometimes but I've been in Thailand every time I've applied for my work permit.

The WP.3 is the one where you physically have to have been stamped out of the country for your employer to apply for a work permit for you. Then many times the employer sends you the receipt of them having applied for one for you so you can get the Non-B at a thai consulate

WP3 form and letter has to be original, so sending by post take several days or by courier, we used the daily bus to Penang to send the papers. It means you stay outside Thailand for a few days.

Krabi Labor checks when you come in to pick up the Work Permit. You must been outside Thailand on the day of application. That means if you apply 11 Aug your exit stamp must be 10 Aug. Labor Office will provide the WP 3 form and a letter which both you need for application of the Visa to come back.

555 yeh I just gave my guy the happy news, he has just had 3 months in Spain doing nothing so was itching to get back to work,but in reality it's a week and now we know the official stance of Krabi labour for future applications, do you have contact details for the minivan you mentioned for sending to Penang please

Staff changes makes enforcemend changes on different things. Crazy sometimes. But honestly I think they had more than enough of people waiting outside or at home and using the wp3 application. All papers in hand, a 2 day Penang and all sorted. Wish you all the luck and hoping things will work out, and for your newly staff enjoy the holiday in Penang, relax there because on return you have to start working every day.

it's pretty hectic in there these days with all the Burmese, we also did 1 cancellation and 2 renewals this week and was full each time, also seems like a few staff changes have taken place

That is definitly a teriible change of application process. Why make this so hard for the applicants. Last time I asked for the letter we got it within 1 hour, just waiting most of the time to get it signed by the boss.

First one is just a the bill that you paid for the application. Second on is indeed the WP3 acknowlegde application that is needed for the Visa, you also need a letter that they have to give you separete to this wp3 form. You have to ask for this letter.

Wp3 is 1 document on 1 page. It s a document, stating u can get a business visa for one company and one position to apply for a wp. Like a wp pre approval. I guess this is a recent move to crack down on "false" business visa and wp. Once u get it, scan it, send to applicant by email. Then he can print and go to embassy along with the whole application documents that are needed of course. How long to get this letter? Well, they have 6 days to give it to you, all embassies knows that, so... They run some basic checks on company and applicant (thus the 6 days I guess), like taxes paid, licenses ok, company actually exist and open, applicant comply with immigration rules and so on...

If the application is in order you get the 2 needed papers for the Visa Application. If it's get denied after 6 days, don't seem any reason why because application is accepted the person can come back to Thailand with his new Visa. There is absolutly no need to wait 10 days abroad.

Official timeframe to get wp3 is 6 days. I ve asked for it 2 times, each time i expected to get the wp3 quicker but finally it was 6 days in both cases. Which means, stay about 10 days abroad. Worth mentioning also that the wp3 can be denied for various reasons... After 6 days waiting 😞

Ok cool will do that, I will plan for my staff to leave Thai Sunday night then get in early to Labour Office Monday morning. Documents is fine as we renewing 2 other WP this month so all are correct and up to date.

As you said, if you are nice and correct, Krabi Labor is very friendly and willing to help even doing their best in English. Try to play games and the trash bins are filled up quickly. Be awere that you need a stamped letter from them, next to the A5 paper sized form that the wp is applied for. Sometimes they forget that letter.

Best thing to do, he goes Penang, next day you apply early morning, put the papers in envelope with name and hotel, bring to a minivan service, one normally leavs 11.00 and he has papers same night or next morning. He applies for Visa, next day Visa approved and comes back, so it will be 4 days Penang.

His hope was to avoid 10 days in Penang 😊 we are familiar with the whole process but mine and my other staffs were done prior to the WP3 becoming required everywhere, we just can't find reliable info as to whether he needs to be out only on day of application or the full 5-6 days whilst it's processed, we don't want to risk and cancellations with the guys in Krabi office as we have a good relationship with them, I find them the best of all the government offices we must deal with

He can only pick up the Work Permit if he shows and deliver new passport copies with his Non Immigrant B visa.

NO, he must be abroad fe Penang when you apply. You get 2 papers from Ministry of Labor which you have to send to him. Those papers and others he needs for his application for the Non B visa. Or if you prefer: He goes outside, you apply get the papers, he comes back with Visa Exempt or Tourist Visa, get the papers, goes back Penang, apply for Non B visa, comes back and pick up the Work Permit. Lots of travel in that way.
