Do I need a new affidavit from the US Consulate for my child's dependent visa if I have a new work permit?

Question regarding dependent visa FOR child based on American parent having a work permit and non-immigrant visa: Last year when I got my work permit I had to go to US Consulate to sign a sworn affidavit that my dependent child is actually my child, accompanied by child’s US passport and birth certificate. Both parents are Americans but only one has work permit and Visa. Now I have a new job and have to go through work permit and visa process again for me and my child. Do I have to go back to US Consulate to get another affidavit? Or would they have it on record at immigration when I go there to process my visa with my child’s? My employer doesn’t know the answer and regrettably I did not save a copy of affidavit from last year. Any experience with this is appreciated.

There is a good chance you will need a new affidavit from the US consulate stating your child is indeed yours. Although I would check with your immigration office BEFORE you need to get the extension for your child.

Children do need a visa, BUT they are not legible for paying overstay fines till 15 years of age. And till 18 years of age they can not be blacklisted. That they don't get a fine or blacklist does NOT mean they don't need a visa.

Johnny, Please consider this your first and last warning. :/

There is a GIANT difference between not having any penalty for overstaying because you're under 15 and not being banned because you're under 18 AND not needing a visa.

That there is no penalty doesn't mean you don't need a visa, no matter what letter you carry around in your pocket for immigration.

Good for you, you can decide for yourself to let your children in overstay or even without a passport because Immigration don't fine children. Other people may care.

ok thanks. Looks like I’m headed back to US Consulate. They only take appointments on Tuesday and Thursday, so I have to time this right.

Immigration normally don't accept copies of an affidavit. They want to see the real stamp on it.

What about a copy of the old one? I may be able to get from my previous employer in Chiang Mai.
