For the retirement visa, for a married couple, do both have to be 50 or over? Or can one be 50 and the other 45?

Only one needs to be over 50 for the one year retirement visa and then the other spouse of any legal age can get a non-O one year marriage visa if you get a simple Thai marriage certificate.

Every year you will need to reapply for each visa and meet the requirements ie money in bank for retirment and simple document to show you are still married for the other.

It is simpler to use a thai lawyer to set it up but you should be able to sort it without having to leave Thailand.

The "trailing spouse" visa for non-o is just about extinct now. The simplest way around it is for the applicant to get OA visa and the spouse can attach to this, or for the spouse to get DTV in the interim until attaining 50 years of age

you cannot get a non-O visa based on trailing spouse in Thailand. No immigration office in Thailand allows conversation to non-O for that reason.

Officially there is no "retirement" visa, there is a non-O visa based on being 50 or over. So logically, the only people who can get that visa are those who are 50 or over. If your embassy sells the "trailing spouse" visa, then your wife could get that based on your non-O. But we haven't heard of any embassies that sell this anymore for a non-O holder as of this year. Some embassies will still sell it if the initial person gets a non-OA visa, but that has much higher requirements than the non-O visa.
