TLDR : Answer Summary
Currently, Thai law does not recognize same-sex marriages or partnerships, meaning that a pensioneer cannot apply for a Non-O visa for a same-sex spouse. Both individuals would need to apply for separate visas. The partner not meeting the retirement age (50) would have to explore alternative visa options like a tourist visa, or look into more expensive options like elite or LTR visas.
LONG TERM RESIDENT (LTR) VISA RESOURCES / SERVICES
Thailand does not recognise same sex marriage (for now at least) so you would each have to get your own visas. Your partner could not get a Non-O for retirement either as he is not 50. So tourist visa is his option unless he wants to look at elite or LTR visas which are not cheap
Due to the current Thai law regarding the non-recognition of same-gender marriages/civil partnerships, it is my understanding that you do not classify as a spouse or dependent.
