Can someone extend their visa-exempt stay to apply for a new Non-B visa later?

Need help if anyone has experienced the same.

Someone's Non-B was cancelled on arrival because the company missed getting the re-entry permit before they travelled. They were allowed to enter visa-exempt, but their work permit is still valid.

They've been told they'll need to leave Thailand and apply for a new Non-B.

The question - Can they extend the current visa-exempt stay first and reapply for the Non-B on their next trip out, or could the extension affect the new Non-B application?

Thanks!
Answer summary
A user seeks advice on whether they can extend their current visa-exempt stay after their Non-B visa was cancelled upon arrival, due to the company's failure to secure a re-entry permit. Various commenters clarify that since the Non-B is no longer valid, the work permit is also likely invalid. They discuss the implications of extending the visa-exempt stay, confirming that it generally will not affect a future application for a Non-B visa, but note that the user may need to start fresh with a new work permit and Non-B visa.

I am pretty sure that is on the individual, not the company, for not getting the re-entry permit at the airport before leaving. Nothing to do with the company. Also, as someone else mentioned, you get the Non-B via the embassy. It is valid for 90 days. Once in country, you use the Non-B at immigration to get a one year "extension of stay" based on having entered on a Non-B. However, you dont have a Non-B anymore, because it has expired. You have an Extension of Stay based on the Non-B. You will need to check to see if the canceled your work permit. If so, you are not just starting over with a Non-B, you would be starting over with getting the work permit as well. I dont think the extension would impact an Non-B application. An extension is issued by the Dept of Immigration while the Non-B will be issued by the Ministry of Foreign Affairs.

"Someone's Non-B was cancelled on arrival because the company missed getting the re-entry permit before they travelled" - no, the person who travelled did not get a re-entry permit

OP
Graham Seal yes obviously, but due to the company's mistake on their process and instructions. Anyway, irrelevant. The questions dont ask who is right or wrong.

The work permit is not still valid. You can’t be on visa exempt and have a valid work permit. It became invalid as soon as they left without a re-entry permit.

OP
The reasons for extension has nothing to do with work. And yes, no work is allowed until visa is sorted.

Many companies want people to apply for the Non-B visa outside of Thailand as the paperwork required is considerably less. If the company would provide the extensive paperwork required to apply inside Thailand he could. But why would they want to extend, they aren't allowed to work on a visa exempt entry? Although extending it won't affect a visa application. They will likely also require a new work permit to go with the new visa

Are you sure you are on an B visa and not an Extension of stay for employment, as I always understood the EOS is cancelled your work permit is gone and you have to start all over

Do you do 90 day reports ❓.. If yes you had an EOS not a B visa

And until you sort this out you can't work either

Not right now as currently entered on exempt, but usually yes.

Anonymousgirl117 so if usually yes.. You were on an extension of stay not a non imm B

You have better check check with the DOL as typically once you EOS is gone your work permit is automatically invalidated

I suspect you entered orginally on a single entry Non imm B, which was converted to an extension of stay for employment for which you need and pay for a multiple re-entry permit which sounds like you employer never did

I will gladly be corrected but I think you need to start all over with a new WP and a new Non imm B and technically right now on a visa waiver you shouldn't be working

Paul Anthony McDermott currently on exempt (60 days entry). But yes, also have a feeling it may all need to be re done 😕

OP
Paul Anthony McDermott its deifnitlly a non b.

Renewed non b, and work permit. Both successfully. Except the step about getting the correct re-entry stamp prior to exiting the country.

Therefore, on the next entry, immigration said a step was missed and must re apply for the non b again. Let them in on an exempt.
