Can my wife change her address in her house registration book if we are registered at a different location?

My Thai wife owns two houses approximately 600 kilometers apart in Thailand, and she now wants to sell the one we spends less time in. Our property agent advised her to change her registered address in her dark blue Thai house registration book (Tabian Ban) to the same address as the house she's selling to save significantly on sales tax (if it’s sold). However, both she and I are now registered as to live in the other house as in the house registration book and on TM30 address report.

My plan is to soon make an extension (60-days likely) based on that I entered Thailand on a Non O E-visa as married with January 29th as my last day on my current 90-day stay permit in my passport. Our current plan is to leave Thailand on like March 29th as to go back living in Sweden until October.

Questions.

If my wife wants to change address in her house registration book after I done my extension on the location that we are registered to live at currently. Do we then need to travel to the location of the house for sale and go to the local Immigration Office there as to make a new TM30 Address Report.

Can my wife change address as in her existing dark-blue Thai (Tabian Ban) House Book or do she need to get another as to get registered as she is living in the house as is to be sold?

Get a rent lease from your wife where your TM30 is registered. Her changing address will have no effect on either of you. I know people that registered at friends house so their children go to a better school. BTW your wife registering at house for sale makes perfect sense regarding tax.

You can own multiple properties of course.. but a Thai national can only be named as the primary resident (main householder) on one blue book at any given time.. since it recognises their primary residence.. if you buy a second property you will be given the blue book for it but the name will not be changed.. it remains in the name of the seller until you sell your first property.. unless you elect to have it nominated as your primary residence and have your name taken off the blue book for the first house.. which in theory could be changed into the name of an adult child living with you.. should that be considered appropriate.. or somehow more comforting.

to make it more clear: you can only reside at one address and therefore be registered in that house book.

The other address house book will be blank.

The owner of my rented house has never changed the name in the house book, it’s still in the previous owners name. She told my Thai lady she has a house up north and can’t have her name in 2 house books ? The electricity and water bills are in the previous owners name as well.

Your wife can only be named on one blue book as the primary resident.. which is why the agent made this suggestion.. which makes a lot of sense if you don't sell it until she's held the blue book for that property for 1 year.. better to research what your tax liability is likely to be before you waste your energy though.. it may be such a negligible sum that you just decide to pay it.. and if your selling price only just takes you into a profit.. it's also worth considering lowering the sale price slightly and then charging the buyer for incidentals you are including.. such as the aircon or other movable features.. so as to differentiate between the bricks and mortar and the rest of it.. such as furnishings or other portable fixtures.. eg. a car port could be taken down and moved to another property in theory.. so could be sold to the buyer under a separate contract that falls outside the actual property sale.. just to give you an example.. the land office is only interested in the agreed price for the purchase of the land / main house.. so with a buyers co-operation you can potentially reduce any tax liability.. if your property lends itself to such.. once sold your wife can put her name back onto the property where you will be living again.. but none of this affects your tm30 because she remains the owner of it and should already have an account on the immigration website to register your tm30's.. so won't need to upload another copy of her blue book.. if that was your concern my friend 😉

Thanks! My wife has only owned the land and house she wants now to sell for a period of little more than 3 years. So it remains almost 2 years until she has been the owner for the required 5 years as to get the lower tax liability. Or she has to change her primary address as in her house book and wait to sell for one year after the change…

As I my self thinks I does not want the house to be sold as it is very nice house and in a good location. Secondly if to be sold anyway it’s better to do it if and when a potentiell buyer shows up as I am aware it’s very difficult to sell properties in Thailand (as it looks to me). The difference as it get in sales tax is a negligible sum as I see it. But…I am not the legal owner and my wife see differently on this than I do…

So I would like my wife to keep her primary address as it is currently (the other house as is located about 600 km away from the house as my wife now wants to sell. With then me also still be registered as the place I stay while in Thailand.

But as the owner of both properties it doesn't matter which one she has registered as her main residence.. as far as your tm30's are concerned she could register you as resident at either property.. regardless of her blue book status.. her name is still on the chanute deed.. my point being that whatever she does it won't change anything for your tm30 status 😉

As stated, your wife’s house book registration is irrelevant to your tm30 or 90 day reporting.

I rented a condo with an empty blue book and had no issues.

It *might* affect a marriage visa renewal, but I doubt it.

FYI a property must be use as a primary residence to be qualified for PRIMARY residence aka ภาษีธุรกิจเฉพาะ taxes when sold. There is also time restrictions, 5 years ownership or 1 year as a primary residence.

There is a “promotion” the transfer cost for as low as only 0.01%!!! This law was implemented a couple of years ago in hope of booting home selling but as everyone can see….😅

I am registered at my Thai in laws house book 3 hours away and has no impact on where I reside for Immigration . If that helps.

What your wife does regarding her primary address has no effect on you, as long as you have a TM.30 registered for the location you are applying for your extension you won't have an issue. However just to be sure, your wife can call and ask immigration themselves or talk to a lawyer.

The fact that the extension is 60 days means it's a Visit Thai Family extension so the OP is concerned if the Immigration Office where he will be applying requires the wife's Tabian Baan which might cause an issue if she is caught in between the two registrations.

Yes. At the previous Visit Thai Family 60 days extensions that I have made. The local immigration did request a copy of my Thai wife blue Tabian Ban (house register book).

The now attached ”general page” of what Immigration requests do corresponds well to what also the local immigration did request related to the previous 60 day extensions that I have made.

Thanks! Yes will do the extension as where I/we are staying the majority of the time we are in Thailand. I have already asked the local immigration earlier if I need to re-visit to make a new address reporting if I been staying temporary on other locations within Thailand? The local Immigration reply was that they do not require this. However that I/we need to make a new TM30 address reporting every time that I arrived to my final destination within Thailand within 24 hours.

TM30 has nothing to do with where someone is registered. It has to do with where you are physically staying.

You are just going to confuse them and open yourself up to problems if you ask at immigration. TM30 is for reporting when a foreigner arrives any address and will be staying there. That's it.
