I have working visa and work permit now, and nearly 50 years old, I wanna ask: after I'm 50, can I apply for the retirement visa while I still holding the working visa? Or I must back to my country first then come to Thailand again with a tourist visa then can apply? It's depends on what nationality I am, different nation, different rules? Or? TIA ๐Ÿ™

TLDR : Answer Summary
You cannot hold both a working visa and a retirement visa simultaneously in Thailand. If you are currently on a working visa (extension based on employment) and wish to switch to a retirement visa (NON-O), you will need to apply for the cancellation of your current working extension and work permit. This typically involves obtaining a termination letter from your employer and following procedures at the labor and immigration offices. It's important to consult your local immigration office for detailed steps related to this process.

Okay, from your post,

Q. can I apply for the retirement visa while I still holding the working visa

NO, you cannot. If you are on an extension based on employment already, you can apply for cancellation of the current extension then apply for an extension based on retirement if you meet all the requirements.

Once you apply for cancellation of your extension based on employment and work permit, you cannot work legally in Thailand.

If you are on entry/initial stamp from the Non-B visa, NO, you cannot apply for an extension for a different reason from your original visa (Non-B). You need to leave Thailand.

While you are working, you are on yr ext of stay employment once you finished employment u can switch over to ext of stay retirement in the country. You cannot be holding both at the same time.

You should be on ext of stay employment, once you get termination letter, cancel WP, cancel work visa and immediately switch over to ext of stay retirement. You need to prepare to meet the list of documents your IP needs ....go ask for a list at the offoce you are using.

thank you and I don't want to holding them both. I just want to know: 2-3 months before my work permit expired, can I just go and apply for the 3 months Non-O visa then the retirement visa?

You probably hold an extension, not a visa. When you stop working, and if you qualify for the extension based on retirement, you can change the reason for extension from employment to retirement. I don't think you need to leave the country for that, but you'd best check that with your local immigration office.

no, that's not what I want or my question. I just want to know, 2-3 months before my work permit expired, can I just go and apply for the 3 months Non-O visa then the retirement visa? I don't need that work permit or still continuing working if I can get the retirement visa.

working on visa/extension based on retirement in Thailand is illegal and you cannot have work permit when you are on retirement visa/extension.

ok, I ask again: do I need to wait my working on extension expired, then I can go and apply for my retirement visa? Or 2-3 months before my working on extension expired, I can just go and apply for my retirement visa, so I don't need to leave Thailand and come back again just for applying for the retirement visa?

@Donnie ********
2-3 months before your extension expires, you can start the checklist of things you need to get a retirement extension (e.g. seasoning of funds in your bank account). Your work permit expires on your last day of work, as does your Non-B extension (no matter the date mentioned on them) and they need to be cancelled at immigration, so what you do is you make sure you satisfy the list of requirements for a Non-O retirement extension and get it at your local immigration.

It totally depends on your immigration office if they'll let you do this before the last day of your employment, e.g. in Bangkok they might allow you to do so 1 week before your last day of work but in Nakhon Pathom (speaking from personal experience), they want you to come on your last day of work.

Hope that answers your question.

work permit and extension have to be officially cancelled even after the expiry date.

as I commented below, you need to cancelation of your extension based on employment first regardless of at the end of your extension (expiring) or months earlier.

@Ellie ******
thank you, and what should I do to make those cancellations?
Ellie *******
You cannot hold two Non-immigrant visas concurrently, regardless of the place of issue, the embassy or the immigration office.

If you want to apply for a Non-O retirement visa, you have to give up your Non-B-based visa/extension and work permit, and you cannot work in Thailand.

That isn't affected by nationality.

thanks and how can I give up my Non-b-based visa/extension and work permit? Just wait them till expired? Or I need to do something special?
Ellie *******
@Donnie ********
, you need to get the termination letter from your employer stating you finish working with them as of xx/xx date. Generally, you bring it to labour office to cancel your work permit, get the work permit cancellation receipt, then go to the immigration office with that receipt to apply for cancellation of extension based on employment.

Better to talk about detailed procedures with your local immigration office in advance.
