Can a British family qualify for a guardian visa in Thailand for their children attending a French school?

Hi all,

I am enquiring about whether our current scenario allows for us to obtain a guardian visa. Our current situation is as follows:

We are a British family, with no Thai backgrounds

We wish to relocate long term with our 2 children (3 & 6 years old) to Koh Samui

Our goal is to put them in a registered French school in Koh Samui as they currently attend a French School in France.

We do not intend to work during our time there

Can you let me know if our scenario meets the criteria for a guardian visa?

This is to extend the guardian visa after the 3 months.

As you can see, there is something about the way it’s said...

They don’t said “500.000 Bahts as credit” ... they say “500.000 Bahts as shown in bank statement transactions for the past 3 months”

So you really must open a Thai bank account and use it as much as you can during those 3 months.

Maybe someone who can read THAI can say what’s written up about that.

clause 2.11) which covers getting visa extensions based on raising foreign children (who HAVE visas to be here) is that for the first year the money needs to be in the account for 30 days prior to the application for extension.

เฉพาะใน ปีแรกให้แสดงบัญชีเงินฝาก โดยมีเงินจำนวน ดังกล่าว ฝากอยู่ในบัญชีมาแล้วไม่น้อยกว่า 30 วัน ณ วันที่ยื่นขอตามเหตุผลนี้

In Thai it doesn't mention anything about transactions. It says ไม่น้อยกว่า ฿500,000 โดยต้องแสดงบัญชีเงินฝาก ย้อนหลัง 3 เดือน which means; No less than ฿500,000 must be shown over the previous three months.

I would suggest that that is the same as the other visa requirements where the amount required MUST NOT FALL BELOW the required amount during those three months. Usually referred to as 'seasoning'.

Quite why they mention transactions in the English text, I'm not sure.

Personally, seeing as it's a Thai visa, I'd prefer to rely on what it says in Thai rather than in English.

So...

what I did...

I am French national.

I am in thailand with 3 kids...

I am not working.

I entered Thailand with a tourism visa I obtained from the Thai embassy in Cambodia.

That gave us roughly 3 months (2 months + 1 month extension) to prepare all the documents.

First I registered the kids at their school.

The school gave me, after I requested, all documents I need to request a change from tourism visa to ED visa for my kids at the immigration division 1 in Bangkok (must be done 15 days before the tourism visa expire).

After that, I took a copy of the passports of my kids, plus again the papers from the school plus a birth certificate of one of the kid (no need all the kids) and I went back to Cambodia to request that guardian visa.

They normally ask a bank account with 10.000 us$ on it... you can easily open a bank account in Cambodia but that’s another subject.

I could get the visa without those 10k because my bank statement was showing regular transfers from overseas (they just want to make sure that you can provide for your family)

They gave me a cinglé entry non-o visa valid for 3 months.

At the end of the 3 months you extend it from the immigration bureau with a bank statement (THAI this time) showing at least 500.000 Bahts of transactions during the past 3 months.

That’s it.

First off that's a BAD thai consulate to use to begin with. Even a rudimentary google of it shows that is not the most user friendly consulate in S/E Asia.

Alison Atkin from Cambodia ... the embassy in Phnom Penh .. you will see a few guys at the door there to “help” in exchange of a few more $ ... I used their service .. it’s easier.. I noticed that when I tried to do it by myself they were asking more documents... I always had what they asked but I had to go back to an Internet cafe to print them etc.... so it was a bit annoying .

Now that was what I did.

Maybe there is an easier and faster way that I am not aware of.. we will see the other answers.

Hi Serge. Thanks so much for the information. A quick question, are your children under 12? I read somewhere that ED visa's are from 12 years upwards.

well, we don't need the personal details. it is not that hard to get a visa/extension to take care of kids (foreign or half thai) here. Meet the financials, provide the documentation and you pretty much get the extension.

I say it again .. I am not a professional on Facebook so I am not sure... i don’t mind sharing informations with the “group”.. bit as my answer would include details about my personal life, I would rather not those details to be seen by the entire world... if you see what I mean.

But ok.. i will answer anyway as I rarely see infos on the Guardian visa here... not there since long though...

Thanks Todd. That is really useful. None of those requirements are a challenge for us. Per Darren's comment about an ED for the children. Do you know if this is a requirement in addition to what you have mentioned?

Come here enroll the kids in a school and the school will give you paperwork for you to get the kids ED visas. OR if you can get documentation from the school before you get here you can get ED visas for the kids at the thai consulate in your country.

in order to qualify for a visa based on raising 100% foreign children here you'd need to have 500K baht in a thai bank account under your name only for 30 days before you apply for a yearly extension. You would need to either get 90 day Non-immigrant Type O visas in your country from a thai consulate BEFORE you come here or you could apply for a 90 day Non-O visa once you get here.

Only ONE parent can hold a visa/extension like that per child. So you'd need to have your spouse and you both have the requisite funds one on each child for you both to get those extensions.

OK thank you, I really appreciate the help. I will continue to look at different options. To be totally transparent, we are looking at ways to obtain a long term (1 year) visa as we have an opportunity to spend a year in another part of the world.
