Has anyone applied DTV using Thai Company Registration where you are a director/shareholder of that company?

I am aware that DTV is not a substitute for Non-B visa or a Work Permit.

Hi all,

I am not sure where to post this, so I hope someone in this group will be able to give me advice.

I want to register myself as a foreigner in the Thai company of my family. I know max. 49% shares can be owned and that is fine.

But I would like to validate a few things:

- If I am registered as shareholder in the Thai company, and I don't have a work permit, will this bring me any problems? We will not pay myself any salary.

- If I am registered as shareholder, and something happens within the company. Do I have any rights as a foreigner to claim my share?

- Any other advise that you would like to share with me?

FYI, my Visa is non-immigrant O (spouse), and spouse is the main shareholder of the co.ltd

Been using Covid extensions for 6 months now and am starting to think about alternatives. I’ve started a business (currently in Thais name), what are the costs/considerations associated with getting a work permit through this company?

I want to start this off by saying my goal is to do things the PROPER, legal way.

I

The background......We would like to come to Thailand (possibly with a technical advisor) and train a "Virtual Assistant" for our American company.

The training is very complex/technical and would take between 60-90 days full time.

Our initial thinking is that following the training, the employee would be working remotely, as VA's all over the world do. They would invoice the company for work done as agreed when the position starts. There is a possibility (even a likelihood) to hire and train other VA's if this first one works out.

So here are the Visa questions.... The plan was (for me) to get some kind of thai retirement visa so that I can spend a few months every year without having to continuously deal with making Visa runs, going for extensions etc. Lets say 60 days, twice a year.

1.) Would we be better off starting a Thai company? Would this give me the same benefit of coming in and out of Thailand without issues and hiring these VA's directly.

2.) Would my partner and/or technical advisor also be able to attain needed visas like this? Particularly the technical advisor, so that he can come and do training as needed even if it takes a few weeks at a time.) How many people can have work Visas attached to a foreign owned company.

We are SPECIFICALLY choosing Thailand, even though there are available VA's in other parts of the world, as it is a way to "give back" to the thai economy. But it still needs to make sense both from a personal and a business sense.

Are there any experts in this group that can speak to how to do things legally/properly?

Hi all.

I've currently in Thailand on a Non-Imm O (Retirement) on yearly extensions. I have my eye on a smallish business to keep me occupied. And yes, I'm fully aware of the strong likelihood of losing my initial capital. I have researched this page for similar questions and must admit that there is a wealth of information. Nevertheless, I pose the following questions/answers to ensure I understood all I've read. I defer to the experts and business owners who have jumped through the myriad of steps. For simplicity, I'm using the terms "Retirement" and "Business" visa.

1. I can not convert my Retirement into a Business visa whilst in Thailand.

2. I must leave the country without a re-entry permit which would void my Retirement visa.

3. I must apply for a Business visa in a neighbouring country. This visa costs approx 2,000 baht and is valid for 90 days upon entry into Thailand.

4. Upon entry into Thailand, if I wish, I can extend by 90 days Business visa into a Long Stay (i.e. one year). Cost 1900 Baht (+ single or multiple entry fee). If not, I must do visa run.

5. I can not apply for a Business visa/Work Permit unless I have all the necessary paperwork from a lawyer. (Yes, my next step is to consult with a lawyer).

6. I must register a Limited Liability Company and employ a minimum of 4 Thai employees. I can not do any physical work whatsoever in the business?

7. If I were to visit a neighbouring country Thai embassy, how long would it take them to process my Business Visa?

8. What are the professional (lawyers) and government fees to set this up? I simply want a sense of the approximate cost before I jump into the abyss.

9. Estimate of time frame to set up from agreement to purchase to its resolution (i.e. initial registration/paperwork by lawyer, Business Visa etc).

And most importantly:

10. What options do I have if I don't have a Thai Partner (wife/GF nor BF :). TBH, I don't know any ONE person that I can entrust an unearned 51% majority ownership? This could very well be a deal breaker for me. My other option is two have two unrelated Thais own 25.50% each which would protect me, however limited.

I'm sorry if the steps above are out of sequence.......... and so long winded. I would appreciate if you would reference the number to which you are answering.

Hi friends, I have a question, please can any one can help me qith the answer? My uncle wants to open a business in Thailand, so I contact a agent who helps with the making business there. But the problem is my uncle wants to open business under his name. So the agent said first I need to open a business license with tax file... then he can do anything with that license and file, as like he can open business under his license and can buy land under that license to make business building....
