I have a thai spouse… im too confused abt the visa. I want to do business in Thailand. I will come there on 17th so I think I have time to get the correct VISA on time.

I also have VISA on Arrival which is a tourist VISA which gives me 60 days to stay…

passport holders of India, married to a Thai wife, have FOUR choices of entering Thailand:

*** they can buy a “visa-on-arrival” for 2000.- THB at the Bangkok airport, and will receive a stay permit for 15 days

*** they can arrive “visa-exempt” (without a visa) and receive a 60-days stay permit

*** they can apply for a 60 days single entry tourist visa in India before they fly to Thailand

*** they can apply for a 90-days Non-Imm-O family visa, based on being married to a Thai wife. For this visa, they need a financial proof. They have to show either an income of minimum 40.000 THB per month, or a bank deposit of a minimum of 400,000.- THB

***You are NOT allowed to work on the first three visa categories

*** you are allowed to work on a “1-year Extension of Stay Permit” based on being married to a Thai wife, but you will need a work permit from the Labour Department in order to do so. Most professions are forbidden for Non-Thai people. Kool Breeze has outlined the most aspects you have to consider

You have a lot more to consider, given what you want to do, than simply the visa. First get a type O visa based on Thai wife. This has two advantages, first being you can work with this visa, and get a work permit, but that is not the main reason in your case. The main reason to get that visa is going to be the actual cost of you doing business, and the requirements to get your work permit, that you can not do any work without, not even volunteering. For a regular business you can only own 49% of it. The rest must be owned by Thais. The next things, and this is where being on a marriage visa comes into play, you must have bt2million in registered capital in the business, and hire at least 4 Thai employees you pay wages and social security on in order to get your work permit. If you set the business up with your Thai wife those amounts are cut in half, bt1million in registered capital, and only hiring two Thai employees to get your work permit. There are other business structures you can set up under, but any other business structure with require the bt2million in registered capital for your work permit. I might add that one of the Thai workers can be your accountant, as accounting is a restricted occupation for Thais only, and you must have a licensed Thai accountant. If you are working purely remotely, with no business of any kind done in Thailand then you have another option, but that doesn't sound like your intention. For the visa itself you will need bt400,000+ in your bank account, together with your marriage license, a copy of your wife's ID card, and a copy of the house book she is listed in, she will know all about this part. Also copies of your passport. These will get you your 90 day marriage visa before you enter Thailand from the Thai embassy/consulate you apply through. Once you get to Thailand you get a Thai bank account in your name only, and transfer the bt400,000 into that account. You go to immigration, with your wife, and get the list of documents needed for your one year visa extension. When you have all these documents, and it is nothing difficult to get, it just takes time. When your bt400,000+ has been in your Thai bank account for two months then, together with all the documents, you can apply for your one year extension. Remember though, when ever you are dealing with immigration concerning this visa, and extension always take your wife with you. Keep copies of all the documents, as the following years all you need is updated bank letters, and new pictures. Everything else is the same, unless you moved.

You have 8 days - and you think that’s enough time to get the ‘correct’ visa? When you don’t even know what the visa type is!

And no, you do not get visa on arrival. As has been stated hundreds of times on this site - you get visa exemption that allows you to stay for 60 days.

you said you wanted to get the correct visa in time for your trip, so that you can do business. As mentioned, there is no 60 day visa on arrival. However, there is a 60 day visa exemption for some countries, but this wouldn’t allow you to do business.

Well ‘buddy’, there is no 60 day visa on arrival, buddy. There is, however, buddy, a 60 day visa exemption, to which I referred in my previous post. You don’t say the nationality of the passport with which you will be travelling, so I had to take a guess.

well, Mr. Know-it-all, if you really know that you will get a "visa-on-arrival", you need to be aware that this visa will allow you only 15 days in Thailand. You will NOT receive a 60-days stay permit. A 60-days stay permit is only for citizens of 93 countries listed to be able to do a "visa-exempt entry". This is NOT a "visa-on-arrival"

Get the non-O visa based on marriage before you come to Thailand.

In order to work in Thailand you need 2 things:

1) a visa that is not work prohibited

2) a work permit

It just so happens that marriage visa is not work prohibited. So you'll already have the right visa if you get that first.
