What should I do if my visa extension is under consideration and my current visa is about to expire?

I changed my extension to visa, and officer gave me this underconsideration stamp. She told me not to come on 23rd rather to call them so i can ckeck if visa is ready. My question is what they mean if visa is ready since my extension runs out on 24th. Will I be overstaying if visa is not ready on 23rd?

Okay, listen up people

we're getting things confused because rather than make your OWN posts asking your OWN questions you started asking on this thread and it got "muddy"

This is how it works

you apply for the initial 90 day Non-Immigrant type visa for 2000baht <- just like

did and you get a receipt that says your application is under consideration and to come back on xxx date for the results.

**During THAT time you CANNOT leave thailand 😮

Then you go back get the Non-Imm visa inked in and a new 90 day stamp

**IF you want to leave during this 90 days you need to BUY a re-entry permit (and it will only be good for those 90 days) 😕

Then when you have 30 days or less left on that 90 day stamp you apply for the year extension for 1900baht and if its an extension based on marriage you get a 30 day under consideration stamp

Then you go back to get the year extension inked in and THEN you can buy a re-entry permit that is valid the whole year the same as the extension stamp.

Just ran into the same problem in phuket immigration. Was told to bring passport back today for a non O stamp (converting from TR expiring today), and was then told the visa wasn't back yet. They took the passport and said they will call to advise to return to pick up in the next day or so. We submitted it about 3 weeks ago...🤷‍♀️

they said don't come back until we call you. I asked when? He said maybe today or tomorrow, but wait for the phonecall first before showing up. Technically overstay status starts at midnight today.

I think he wasn't sure either 🤔

it's NOT overstay because the Non-O visa starts when you apply for it NOT when you go to get it inked in

Same as the 30 day under consideration for the yearly extension, that's actually the first MONTH of your new year extension so you're not on overstay you just haven't gotten the stamps yet.

But seriously, we have the receipt and pics of the passport and visa. I think it's ok.

And it's my 86yo mother's passport. I'm more worried about needing it for a hospital lol.

common occurrence in Phuket (leaving the passport with them).

NOT so common any any other immigration office. They just tell you to call on the date the stamp comes due and they'll tell you if the paperwork is back or not. If not they will tell you when you check back

Even if it's not approved by the date your current stamp runs out you will NOT be on overstay 🙂 That Non-O visa starts the day you APPLY for it (so it started the 9th of Dec) and when you show up they'll just ink it in to your passport.

There is no issue at all not having a valid stamp in your passport with that receipt..

MANY smaller offices <- of which Nakhon Pahtom is one 😛 have to send the documents to the main division office for approval and they sometimes take longer than the under consideration period.

Keep in mind though you CANNOT leave the country on this under consideration period.

you can't leave the country on the initial 90 day Non-Immigrant type visa application. 😕 The one for 2 or 3 weeks until you get the visa

On under consideration for the yearly extension of stay application based on marriage or raising thai children you CAN leave during the under consideration period but you would need a re-entry permit and it would only be valid for that under consideration stamp

you have a receipt that says you're under consideration until the 23rd of Dec, WAIT and get ahold of them that date.

if you applied for a VISA <- as in a Non-Immigrant type visa the office you applied at would have given you a receipt that says when you return to that office to get it inked in

You needed the required number of days left on your stamp to cover the under consideration period. <- You need to be able to stay here on the stamp you have until that period expires.

For instance:

in Bangkok you need a minimum of 15 days left on your current stamp because the under consideration period is 14 days

in Chiang Mai you need a minimum of 21 days left on your current stamp because there the under consideration is 15 WORKING days..

I said I have NEVER EVER seen an under consideration on a Non-Immgrant visa of any type denied <- as in not one single time EVER

if they took your paperwork, if they took your 2000baht, and if they gave you that blue green receipt it WILL be approved.

A follow-up question: If the original poster got his visa extension denied (all my wishes for him to get it smoothly), what becomes the latest day he has to leave?

It would be great the immigration offices inform clearly about the conditions of stay in all and edge cases. 😕

OP is applying or an in-country visa, not an extension. Those are different.

i have never seen an "under consideration" receipt for an initial Non-Immigrant Type visa EVER not be approved. As in not even one single time..
