What should I do if my passport is expiring soon and my embassy cannot issue a new one in time for a visa extension in Thailand?

Advice:

My passport is expiring 18 April 2021 and my embassy just got an issue with their system and will take 3 months to give me a new one, so that means for a covid visa extension they cannot stamp my passport longer than the expiration date in 3 weeks and I will be with no legal document here. My embassy offered me an emergency passport but I don't know if at immigration they take that as legal document (I came here and they said it dwpends on the answer of the government, so nothing clear)

For the moment I also see the option of going out and come back.

Anyone who sees a solution that I'm not seeing? Or the cheapest way to do any of these two?

Please would really appreciate your advice in this moment.

TLDR : Answer Summary
The poster is facing an urgent situation with a passport expiring soon, which complicates their ability to secure a visa extension in Thailand. Comments suggest several options: obtaining an emergency passport (usually valid for one year and can be used for visa extensions), returning to their home country, or risking an overstay penalty. It is advised that the poster checks with their local embassy for specifics on the type of emergency document available to them, as policies differ by country. It is crucial to act quickly to avoid legal issues with immigration.

I'm closing comments.

The OP is from Chile. It's unknown exactly what type of document they would give her. If it's an emergency passport, then she can get the stamps transferred. If it's an emergency letter to get home, then she can't. Different countries have different policies, and we don't know what that policy is for her country.

However, some immigration offices are starting to resist giving out the 60 day extension of stay based on unable to travel due to COVID-19. Living in Thailand on the 60 day extension of stay based on unable to travel due to COVID-19 is not a long-term strategy.

The only thing you can do is to get this travel document (passport? letter? I dunno), and apply for the extension. The worse they would say is no.

What other nationalities do is up to those countries. Good luck!

Some country issue emergency passport (as Daniel describes above). Some issue only emergency travel document to go back to your home. Some issue both - one of them. What's OP needs to do first is check with her embassy to see which she can get. So far it seems like nobody knows how Chilean embassy does with "emergency passport".

Last year my American passport was going to expire (typical 10 year passport) the USA embassy was told that issuing standard 10

Passports was not possible due to government office closed in the states so they issued a temporary one year emergency passport and I used that for my annual visa extension. Immigration has no issue the only problem was my yearly extension was cut short by 2 months since the emergency passport cut short before the expiration. Don’t worry—emergency temporary one year passports r fine!

An emergency passport is different to an Emergency Travel Document - for a UK passport holder. An Emergency Passport is a 6 page passport with one year validity. An Emergency Travel document is supplemental piece of paper. So if emergency passport you will be fine with Immigration.

For UK citizens there is only an ETD which is sometimes referred to as an Emergency Passport - valid for 1 year, but there must be a journey itinerised : "The emergency passport can be used to make a single or return journey to the UK or another country of residence, via a maximum of five transit countries.

The emergency passport is issued with a validity which is limited to the shortest time appropriate to the holder’s travel requirements whilst taking account of the transit and destination country requirements (for example, many countries require travel documents to have a minimum validity of six months)."

"You will be asked to provide an itinerary for your journey".

I was categorically told by the UK Consulate that an ETD could not be used for Immigration purposes - only for travelling "home".

That is true for an ETD. There are UK Emergency Passports that Embassy’s and Consulates have. Trust me I had one issued by the British Consulate in Cape Town. The reason to issue one must be compelling and its at the discretion of the Consul-General or Ambassador. But the poster is getting an Emergency Passport from Chile so all good.

I once used an emergency travel document with an expired emergency passport. Not something you should aspire to. 🤦‍♂️

Your options are:

- leave the country and go back to where you come from

-do nothing for 3 months and end up on an overstay of more than 90 days where you're banned from the country for a year.

- get a covid extension on your passport that takes to until april 18th

OR

-get an emergency passport (which usually are good for a year AND which you can get extension stamps issued on) get a covid extension and pray there is some other extension plan comin' up so you can stay legal until you get your new passport

That's pretty much the choices you have :(

My wife and I were once stuck in Los Angeles because here German passport had less than 6 month on it. Within a day she got a one year passport from the German consulate and we were on our way to Thailand entering with no problem.

A German emergency passport is just valid for 6 month and immigration except that

the chilean embassy offered me a emergency passport but they were not sure at immigration in Samui if they can give me the visa extension there. So you are saying they can? That would be amazing!

What's the harm in trying? I imagine that "not sure" can be turned into a YES with enough talking.

(once you have the emergency passport in hand)

You cannot remain in the country without a passport with valid visa/extension. An Emergency Travel document is only so you can return to your home country. I would suggest you may have left your run a little late, and may have to return to your home country as quickly as possible. Beware once your visa expires you will be on overstay.
