What should I do if I received a 90-day stamp when I expected a 30-day entry in Thailand?

Hello, I arrived in Thailand the 30th of November and expected 30 days (visa on arrival). Somehow I got 90 days instead and when I asked my lawyer she said itโ€™s all good.

My nationality is Dutch and I heard they changed the rules and some nationalities now get 90 days on arrival, yet I can not find anything about this. Can someone confirm this? Thank you kindly ๐Ÿ™

TLDR : Answer Summary
The user mistakenly received a 90-day stamp instead of the expected 30-day visa exemption on arrival in Thailand. Despite their lawyer claiming it's fine, multiple comments clarify that the user is currently in overstay since their actual 30 days would have expired on December 29th. They are advised to return to Suvarnabhumi Airport to correct the stamp and then proceed to the local immigration office to apply for a 30-day extension. It's emphasized that checking the entry stamp is the traveler's responsibility.

Personally what I'd do (no matter where you are in thailand) IS;

Go to Suvarnabhumi airport this weekend (they are open
****
) get the stamp corrected.

Then show up down there at the Island of Misfit Toyz (aka Koh Phangan) immigration office bright and early monday morning so when they open at 8:30 you can get this overstay cleared and get your extension.

I say that because if you wait until Monday and that office WON'T correct the stamp then you have more overstay fines while you get up here and get the stamp corrected, then go get the extension

Sometimes happens they wrong to set stamp....in my old passport have one date of exit before the date of entry.....from that time always double check!!!!!

You MUST go to Survarnabhumi ASAP get it sorted. You are now on overstay. If they change the stamp they may hold you and deport you as you donโ€™t have an extension.

okay let's not start scare monger, ๐Ÿ™ they aren't gonna hold and deport him, another poster just had a bad stamp corrected (and they too were on overstay) and nothing happened. All they're going to do is correct the stamp for him

You need to go back and fix it. This is the second one Iโ€™ve seen.

it's likely your Only option...

Suggest you read and re-read the replies to you FROM Tod Daniels. He's the EXPERT.

You just might be VERY Lucky ๐Ÿ€ if your local Thai Immigration office will correct it... BUT in our experiences on Thai Visa Advice forum, you will need to go back to BKK Suvarnabhumi Airport Bangkok Thai Immigration Officers to get it corrected.

And...

We wish you success in getting your extension of stay.

7 days overstay already, that's 3500 baht fine so far.

@Vernon ********
it'll be 10 days by monday which is the soonest they can get to the immigration office now

It's a mistake, it's been happening a lot lately. Thing is it's completely your responsibility to check it and have it corrected. Yeah I know.

You need to go back the airport to customer services/ information desk and tell them. They will call an immigration officer to come and correct it for you.

It's called a 'visa exempt' just so you have the correct terminologies when there.

It's all you can do. You're currently on 7 days overstay and 10 if you go to immigration on Monday.

You have to go back to the airport asap and get it corrected. It's B500 per day fine and a flight out.

Tod is the resident expert and has dealt with this over and over again. Take his advice over anyone's.

@Tom ********
which while unfortunate doesn't change the fact that an immigration office can tell you to go back to the place that stamped you in to correct the stamp.

First off your "lawyer" is confused and 100% WRONG ๐Ÿ™ You're about as far from "all good" as you can throw a stick ๐Ÿ˜ฎ

Okay, you arrived and were expecting a 30 day visa EXEMPT entry (not a visa on arrival, just a free entry stamp) but sadly for you they stamped you in wrong..

You were only supposed to get a เธœ.30 stamp <- 30 day visa exempt

You CANNOT stay the 90 days, and in fact right now you're on overstay since Dec 29th ๐Ÿ˜ฎ <- the day your REAL 30 day visa exempt entry would expire..

You need to go back to Suvarnabhumi and get the stamp corrected, THEN you need to high-tail it to the immigration office where you stay (if you're in Bangkok you go to the one at IT Square Laksi Plaza) and apply for the 30 day extension.

IF you can get there Monday you'll get fined for 10 days overstay (500baht a day for 10 days = 5000baht) and then you can get your 30 day extension, which will be dated from the actual date your corrected stamp shows (which will be Dec 29th)

Just so everyone is clear about this, YOU are responsible for checking your passport, making sure you're stamped in correctly and if you're stamped in wrong YOU need to get it corrected and are responsible for any overstay that occurs on that bad stamp.

my โ€œlawyerโ€ told me she checked with immigration even. Yes she is an actual lawyer who set up my thai company to. I am in Koh Phangan though. Would you suggest going to immigration here? And go back to my lawyer and try to fix it with her.

๐Ÿ˜ฎ I'm saying you you were stamped in WRONG 100% and that's gonna be on you. Don't care what that lawyer told you ๐Ÿ™

You can't stay the 90 days you were stamped in for, it's a bad stamp.

You can go to that renegade office down there Monday and see what they say, BUT

I am thinking they're gonna say go to Suvarnabhumi and get it corrected,

Still, you're out nothing by trying it, and who knows maybe they'll correct it to Dec 29th (like it should be) then charge you the 5k overstay and the 1900 for the 30 day extension which would be effective from the 29th of Dec (so only until Jan 28th)

Just so you know;

They changed the rule on Nov 1st until April 30th for RUSSIAN passport holders only.. They get 90 days and other than the 5 countries that always got 90 day entries (Argentina, Brazil, Chile, Peru, South Korea) no one else gets it
