What happens to my Non-B visa and work permit if I sell my company in Thailand?

Hey guys! I am a director, have a WP and got my 1 year non B visa in Penang 2 weeks ago. I decided to move out from here within a year so I am thinking to sell my company before I leave. The question is about my current visa and WP - will it stay with me or will be cancelled once I stop to be related to my company? Dont want to be surprised on the next border run

IF you got a year-long, multi-entry Non-B visa from a thai consulate in another country you can keep bouncing in and out on the visa until it expires.

VIsas can't be canceled when you change the reason for getting them.

IF you have a year long extension from inside the country at the immigration office you need to go and cancel it, then leave the country.

the visa is not tied to the work permit. You only have to cxl the wp then. Nothing changes on the visa.

Only the extension of stay based on business needs to be cxl and that is from immigration.

Visa bought from a Consulate is different then a extension of stay permit from Immigration.

When you sell your company to a new director you will need to have quit work officially, return your work permit to the labour department, with that ur visa will get canceled automatically, in case you dont want to have problems later you will need to give the quitting paperwork to the immigration, where you will get a specific amount of days to leave the country ( i can't remember how many)

ok yes agreed, that is if he has a non b from an embassy and not the immigration, forgot to ask if it was an extension.. i have had a few people say it is a visa so got confused

that is not correct, an extension cancels when you cancel a work permit a VISA does not.

You have to cxl both your work permit and your extension of stay permit based on business when you leave the company. Otherwise it’s 500 baht per day overstay charge.

the ONLY THING FOR SURE is by ASKING as I suggested. Thai Immigration and Ministry of Labor.

And in the morning I am sure you will receive added helpful replies.

As you are doing...its best to gather information BEFORE making your decisions.

your company has to file monthly social fund and they also will be fined 20,000 baht if not notifying you have left within 15 days. The day after that you left starts the 500 baht fine from immigration. The best is to notify immigration a couple weeks before you will leave so your passport is stamped with a exit date.

Trying to cxl your wp and your extension the same day is a bit complicated. It’s not a matter of just showing up at immigration and say cxl my permit. You have to show

1) Letter to immigration from your company stating you resigned on whatever date

2) copy of the company affidavit

3) Withholding tax filing. If it was August 7th, you need July’s filing. If it was August 6, you need June’s filing.

4) passport or ID card of director signed.

5) passport copy of Yourself

6) copy of work permit

7) if you have cxl the wp. The copy of that.

For work permit

1) Company affidavit ...one copy signed by director

2) company stamp

3) director needs to sign the cancelation form

4) original work permit.

You cxl both the wp and permit on the same day. You either leave that day or get additional 7 days extension to leave the country.

might I suggest you ASK your local immigration office and ASK the Ministry of Labor which issued the work permit. You may save yourself OVERSTAY fines. Then you will know for sure. Good Luck.
