TLDR : Answer Summary
To convert your non-B visa into a work permit and secure a one-year extension, you must have the employer who intends to hire you apply for the work permit at the Ministry of Labor. Once you receive the work permit, you can then apply for an extension of stay at the local Immigration office based on your employment. It's critical that the company meets the necessary documentation requirements, which may include showing employment records and qualifications. Additionally, if you are currently on a 90-day non-B visa, this process should be initiated with your current employer before considering other job offers.

- If you really want this new B visa and WP. I strongly suggest your hire a qualified Visa Agent... Many accountants and lawyers are qualified visa agents. I believe that your case will get complicated because your current 90 day B Visa was just given to you for saying the word business... This is quite unusual and it will show that you had virtually none of the qualifying documents to get it. Work Permits are Employer Specific and most often Location Specific ... Who ever is hiring you will have to assist with providing many necessary documents related to the company that is to be your employer...

Thanks Sir, I’m following exactly what you mentioned. The company is handling for me with their lawyer.

in your question there is already a discrepancy..if you got a 3 months non B visa ..one company has provided all the papers for you to get it and you must get a work permit with this company otherwise your NON B visa is VOID ..CLEAR ENOUGH...if another company is willing to process another non B then you have to restart from zero unless you gett a work permit first with the company that provided you the first NON B and a letter from that company that they are fine with your resignation and allow you to get another job in this case you can change the employer on your work permit.
Iker *******
Now to get a non B you must even get a pre approval of the work permit from your employer ...i just did it for my worker in pattaya....so the approval of your non b is based on your curriculum and the job offer of your employer ....
Iker *******
This is the law.....
Iker *******
Totally disagree ....that visa is based on an employment offer that no longer exist annd it is void ....if the employer does not report it nooboly will check....even non O is the same if you break up with your wife you myat leave the country in 7 days because that visa is based on a marriage that no longer exist

@Iker ******
, if it's a real VISA (not an extension) no one can cancel it period. The person is allowed to be here as long as that visa stamps them in for (90 days)

As far as an extension, you have to have the person's passport at the immigration office to cancel one. It can't be canceled if you don't have it.

I believe the O/P has a 90 day single entry visa which has no notation on it as far as what company provided the documentation to get it issued.

I don't think they're going to have any problems getting a company they work for to pull a work permit and get them an extension on it.

I am not gonna keep going round and round with you on this.

I guess we can agree to disagree and the O/P will weigh in on it once they get an extension or they don't.

absolutely not if the company inform the immigration and cancel your visa obviously if nobody check or your official employer does not report it you can stay.....I am sure about it because I have cancelled non B visas the same day I have fired someone it took 15 minutes

I guess many people would like to use this Embassy and getting a Non B by just telling them, have not heard that in a while. I guess this visa can not be extended as, most likely, no wp will be issued.

@Ik**
, it is NOT nearly as cut in stone as you are alluding to. If you get a 90 day Non-B using documentation from one company and decide not to work for them the visa can't be canceled and you can stay for 90 days without a problem.

Not necessary. I got from an embassy in my country. I applied for tourist and they ended up giving me non-b because I mentioned the visit as business.

I used an Auditor who arranged the documents for small money. I needed to go abroad to apply for the Non-B visa (

Work Permit and Visa are two different things. To start: Your friend company goes to the Ministry of Labor and apply for a Work Permit for you. When you have your Work Permit you can apply at local Immigration for Extension of Stay for 1 year based on working. If you get the extension of stay you directly apply for a multiple re-entry permit.
Robert *******
They must be in English language, if not than an official translation.

Thank you. Do I need to attest my qualifications from the Embassy and Ministry of Foreign affairs Thailand?
Robert *******
From handing in the application to collect the Work Permit is about 1 week.

Noted. Do you know how long does it take for the ministry of labour to approve? Secondly, what documents are required for the extension? I.e, employer contract, dbd registration papers etc. Last, do I need to submit my transcripts and does it has to be attested form the country of origin? Thanks for your time.

If you have a 90 day single entry Non-B, you get the company you're going to work for to get you a work permit then you take documentation from the company to the immigration office and apply for a yearly extension of stay based on your employment contract.

@Tod ********
thank you so much for the info.

@Jas***
, then you shouldn't have a problem with an employer getting you a work permit and using that visa to get an extension of stay.

@Tod ********
nope there is nothing.

@Jaseem *****
, on the visa itself under the remarks area is there a name of a company written on it? If not, there's no problem.

I came on a non-b Visa submitting an invite letter for a meeting form another company. While my work permit is being processed under another is that an issue?

If I made unnecessary addition, specific amount of capital is required per one foreign employee, not only the number of Thai employees unless it's BOI company...

And I heard that foreigner-owned company needs to show the capital, in case it's in Bangkok.

@Tod ********
Well,.... I don't know much about this at all. I'm a small business owner myself and I'm only familiar with the requirements for myself as company owner/director to stay within the law. I don't have foreigner's as staff (yet) But it's interesting to know. Being able to pass on correct info when asked (which happens a lot)

@Phillip *****
Got it, I'm sure they have in 3 digits.

@Jaseem *****
, the company will have to have 4 thai nationals jut to cover your work permit .

@Val***
, believe it or not far more people work here on yearly extensions than play the run to a consulate to pull a year-long multi-entry Non-B and border-bounce every 90 days. :O

A lot of people in the south on the islands ere on yearly Non-Bs like that, because their company or the agent who gives them paperwork can't meet the requirements at the immigration office.

@Tod ********
for your help.
Tod *********
@Jas***
, yep, those companies already know the documents required.
Valère *************************
@Tod ********
Understand. Interesting this is possible. Did not know this. I thought the route 3 month first and then 1 yr trough a consulate abroad was set in stone.... Thanks for the new lesson :-)
Jaseem ******

@Tod ********
IS it easier for those companies who already have foreign employees? Considering they have went through this process?
Tod *********
@Val***
, lists of share holders, board of directors, list of employees, their wage, the amount of withholding on them, tax statements, etc. It's a pile o' paper really.
Valère *************************
Tod Daniels Aha. I understand now,... Thanks. I think the numbers on the balance sheets and number of Thai citizens employed have something to do with that right?
Tod *********
@Val***
, that is correct.

BUT a lot depends on the company they are working for. Some companies cannot meet the required documentation to get their employees a yearly extension of stay which is why they send them to a thai consulate that issues year-long, multi-entry Non-B's instead.

The documentation is way different between what the immigration office wants inside the country to give you an extension and what a thai consulate wants outside the country to sell you a visa.
Valère *************************
Tod Daniels So those who have a 3 month Non-B and then acquire a 1yr WP during that time don't need to get out of the country for a 1yr Non-B but can get a 1 yr extension at the local Imm. Off.? Am I reading that right?
