TLDR : Answer Summary
When a company's work permit is canceled, the foreign employee must typically take immediate action regarding their visa status. If you hold a Non-B Visa with an extension of stay, the cancellation of the work permit invalidates the visa often necessitating departure on the same day or securing a one-time 7-day extension. This extension allows limited time to remain in Thailand; after that, alternative visa arrangements must be made. Clarification is needed if the visa is linked to ongoing employment or specific extension stipulations. Employers may notify immigration of the cancellation status, but it's the obligation of the individual to manage their stay according to official residency requirements.

If your company is a BOI, you will likely get 15 days automatically if requested and can have 6 more days as extension, totaling 21 days…maybe this applies to you?

If your company cancelled your work permit that means you are no longer working for them, and no longer meet the terms of your visa. You are now on overstay, and building up a fine of bt500 each day since you no longer had a job, with a maximum of bt20,000.

7 days after wp is cancelled. Visa is based on the wp. No wp. No visa.

ok I am more confused after all the posts. I am on a Non B Visa which lasts for 12 months. Stamp says"extension of stay permitted up to
*****
/23. Holder must leave with the date specified." Based on that visa and stamp can I stay till the
*****
/23 or do I have to go to immigration same day and apply for extension? Thanks!

As I said earlier with an extension of stay as soon as the reason for the extension ends so does the ability to stay in Thailand. You need to leave the same day or get another extension for whatever reason.

Thanks Stuart for clarifying. Office saying they will notify immigration the cancellation date of the Visa and work-permit effective 20 Jan 2023 (Which is last day on the Visa) but will do that 21 days in advance (reference image attached.) Does that sound legit they can do that in advance? Concerned they screw it up and I am stuck with overstay.

@Russell ******
Not sure they’ll allow that far in advance but quite possibly they can.

Stuart, how does Immigration (or specifically, the Immigration Officer stamping your exit upon departure), know whether or not your separate Work Permit has been cancelled (versus simply seeing your permitted date of Stay from your original Visa) -- i.e. Does the Employer notify Immigration, and that is then noted in their computers on the employee's file?

Don’t know the answer to that one. My guess it’s noted on a database somewhere. Generally what tends to happen is that your employer gives you a letter stating your employment will end on xxxx date. You take that to the MOL and get your work permit closed. With the letter from MOL you go straight to immigration and they’ll stamp you to xxxx date (provided that’s in the future of course).

that visa is given with work permit, so if work permit is canceled, your visa is no longer valid

If it's an extension of stay, then it's the nominated date. If it's a 12 month visa with a 90 day stay limitation on each entry, then whether you have a work permit or not doesn't matter. You can continue staying on your current stamp and then depart and re-enter to get another 90 day stamp until your visa expires.

You will have to depart the day of your termination letter stating you need to depart… If you want more time go to immigration apply for the one off 7 day canceled get out of Thailand extension it costs ฿1,900 baht…it’s
*****
percent you will get it…after that if you want to stay longer look into different visas…good luck

7 days when cancelled

Once the MOL cancels the work permit, the foreigner must bring his or her original passport with the visa stamp to the Immigration Department to have it cancelled. The foreigner must then either leave Thailand the same day or apply for a 7 day extension on the same day.

@John ********
There is no 7-14 day extension. Some offices may let you apply for an extension (usually needing proof of a flight out), but that application will be denied and a stamp saying such would be put in your passport. You would then be given 7 days to leave.

@Stuart ********
apologies predictive voice text. I meant 7 days only
Stuart *********
That depends if you are on an actual visa - as in a sticker in your passport or a PDF file you got from an embassy or you’ve got a stamp in your passport saying “extension of stay”.

If the former then you can stay until the length you’ve been stamped in for.

If the latter then you must leave the same day or get a different extension of stay. Your reason for the extension has finished and so has your right to stay.

Thanks. Does the image attached relate to the 'former' you menttioned?

No. that is a re-entry permit. My guess is that if you have that you have another stamp in you passport saying “extension of stay permitted to stay until xxxx date”.
