Does cancellation of my work permit automatically cancel my work visa, and what steps should I take before leaving Thailand?

I found out this week that my old school cancelled my work permit without notifying me even after they had promised they would give my new school time to prepare documents before cancelling it. I am now scrambling about to leave Thailand ASAP. I wanted to find out - does cancellation of my work permit automatically cancel my work visa? Do I need to cancel my work visa before I leave? If I leave Thailand to go and apply for my non-B outside of Thailand, will I experience any issues?

TLDR : Answer Summary
The cancellation of your work permit does not automatically cancel your work visa. If you are on a Non-B visa and have not yet extended it, you can leave Thailand without issue. However, if you are on an extension related to employment, you have two options: 1) Leave without cancelling your visa extension and apply for a new visa at a Thai consulate, which may result in a fine for not cancelling; or 2) Obtain termination documentation from your employer to formally cancel your visa extension before leaving.

If your on an extension of your visa you’ll definitely need to cancel it

If you are on the initial 90 days from the Non-B visa (as in you haven't extended it yet) you're fine, just leave.

If you're on an extension based on employment, you have two choices

LEAVE without cancelling the extension, go get the visa at the thai consulate then come back and deal with the cancellation after you're back, (and get the fine for not cancelling it when you should have)

OR

get the termination documentation from your employer go cancel your extension at the immigration office and leave after that.

Those are the two choices if you have an extension based on employment

you cancel the extension at the office that issued the stamp, so if you got your extension at Chaengwattana you go back there with the termination documentation from your employer and cancel it

in the case my old employer doesn't give me the documentation, what can I do?

you just exit like I said and go thru the cancellation once you get back.

does the receipt of cancellation stamped by the ministry suffice for me to go and cancel the visa or do I need additional letters or documents from the school?

you need termination paperwork from your employer AND the proof the work permit was cancelled. This is why I keep saying GO to the immigration office that issued the extension with what ever you have and see what you need to cancel this extension

If they cancel your extension based on when the work permit was cancelled you WILL pay for overstay but if your termination papers from your employer have a different date they will start from that date.

I have had problems in the past when changing employment because I didn’t have the receipt for cancellation/ return of my Work Permit from my previous employer. It would advisable to get this document from your last employer and/ or ask your new employer for advice. You may also be asked for proof of submission of your income tax return PND 91 by the Department of Labour when you apply for your new work permit with your new employer.

If they did your tax return for you then they should be able to give you a copy of your PND 91. If they didn’t do it for you you will have to get a statement from them of salary paid and income tax deductions and either do your tax return yourself or ask your new employer to help you to do it.
