Missed 90 Day Report

Hello everybody. Im on the DTV and totally forgot to do my tm47 / 90 day report. Im 1 month late on it at this point. From everything I've read, I will be fined 2000 baht now once I do it. Ive also read though that if I just skip this one and do my next 90 day report after I reenter thailand in August, immigration may/may not catch that I missed it.

If they do catch it I'll be fined 2000 baht for my missed one

If they dont catch that it than I would be lucky and save 2000 baht

Is there anyone who has actually experienced this FIRST HAND while on a dtv visa that while submitting your 90 report, immigration did not notice that your previous 90 day report was never submitted and you were able to get away with it and not get charged a penalty? If so I'll take the risk and hopefully save 2000 baht.

Thanks for the help
Answer summary
The post discusses the consequences of missing a 90-day report while holding a Non-Immigrant D (DTV) visa in Thailand. The user expresses concern over being one month late in submitting their TM47 form and is seeking advice on whether to report and pay the fine of 2000 baht, or to skip this report and submit the next one upon re-entry into Thailand. Various comments from the community reflect on personal experiences with fines, suggest that being proactive may lead to lesser penalties, and highlight the differing opinions on the risks involved with missing the report.

There are people on annual extensions for longer term visas that NEVER do 90-day reports. It's not worth their time or effort, so they just pay 2000 baht each year at their extension and consider it a cost of their extension. Missing a 90-day report is not a big deal.

I love it when people mess up then try to game their way out of it. Take some accountability, bud, and be an adult.

Just fly out before the 6 months stamp runs out. Come back to Thailand and get to do the next 90 days report. If you are lucky they won't charge you for the previous one at all since you basically started the clock of 90 days again with your re-entry. If you got a bad luck, they will charge you 2k THB. Have never seen immigration asks you about your 90 days report when you fly out.

Don't worry about it :)

I'm Thai, so I am able to understand the law but I am by no means a lawyer but in layman's understanding......

Your understanding of "Max is 2000 per missed report" is incorrect.

As per the law "พ.ร.บ.คนเข้าเมือง พ.ศ. 2522 - มาตรา 76" Which pretty much translates to Immigration Act 1979 Section 76:

"ค่าปรับกรณีต่างด้าวรายงานตัวเกินกำหนด (แจ้งอยู่ในราชอาณาจักรเกิน 90 วัน) มีค่าปรับเบื้องต้น 2,000 บาท หากเจ้าหน้าที่ตรวจพบก่อนหรือถูกจับกุม จะมีค่าปรับสูงถึง 5,000 บาท และบวกเพิ่มอีกวันละ 200 บาทจนกว่าจะดำเนินการให้ถูกต้อง"

"You will be fined 2000 baht. But if they find out or you have been arrested you will have to pay 5000 baht plus 200 baht per day until you have correctly filed the report".

You can risk it if you want but, I want you to try and ask yourself whether it's worth it, AND whether you really think they would design it so that you can think in the following way (incentivising you NOT to report). If it is as you say I'd say the Thai Law is really flawed but from my experiences I doubt it's the case.

Ofcourse, there might be cases immigration let you go easy and fine you less than the worst, but by the extent of the law you could be fined a lot more than 2000.

For reference, I found the Unofficial translation from the Royal Thai Police website:

**************************************************************

Section 76. Any alien who fails to comply with the provisions of Section 37

(2), (3), (4) or (5), shall be punished by a fine not exceeding five thousand baht and a daily fine of not exceeding two hundred baht until full compliance.

---

Section 37. An alien who is permitted to stay in the Kingdom temporarily

shall do the following —

5) Staying in the Kingdom longer than ninety days, an alien shall notify the

competent official at the Immigration Division, of his or her residence, in writing, without

delay, upon the completion of a ninety day period. This shall be repeated at every ninety

day interval. If there is an immigration office in the locality, the notification may be made to

the competent official of that immigration office.

Good luck.

I hope the people who said categorically that there are no fines whatsoever for non reporting on a 90 day check are reading this.

Actual evidence from people's experience. It can - and does occasionally - happen.

Anonymous participant 585 " "occasionally" happen, is the key word. Meaning it might not, correct? If I go submit now, I'd for sure have to pay 2000. If I just wait and make sure I do my next 90 day report after I reenter, I MIGHT not have to pay for the missed report, and if I do its still 2000 baht. So whats the point of paying now?

I probably say it's always better to come clean rather than wait till the next 90 day, because it shows intent to do it properly and genuine mistake. Get it sorted before the country exit or 6 month renewal because this might cause issues when you do that. 50 pounds is not worth potentially being denied re-entry.

from my understanding, this will not effect entry, otherwise I'd definitely go pay it. Border immigration does not care about the 90 day reporting, Its only for local immigration office

I think 2000 baht is the worst that it can get, no?

go immigration they have the answer ... if you go today or tomorrow you might be able to limit the damage. Good luck

There is no damage to limit. And no reason to go to immigration just to pay a fine.

90 day reporting affects all visa types, there are not different approaches for each visa.

If you do get caught it's actually 4000 so I would just go pay the 2000

why would it be 4000? Max is 2000 per missed report from my understanding

"If you do get caught", which happens once or twice a decade in the whole country. It's just silly considering there's tm30 in place. Should I also go take a selfie with the phu yai ban holding a fresh newspaper with the date clearly visible every 180 days and send it to the immigration?

While I agree it's somewhat stupid. I think the point is to determine the worse case, no?

oh that was last month when I looked it's now gone up, it's more of you are caught before you go admit late yourself.

Missed 90-day report fines in Thailand are a standard administrative penalty of ฿2,000 if you report voluntarily, which jumps to ฿5,000 if you are caught by authorities before submitting it.

I didn't know it was 4000 before. But as of latest info, you are correct, with the addition of 200 baht per day that it's not filed correctly lol.

As you allude to they might catch it and they may not. Depends how eagle eyed the IO is. A pal of mine on the B never does his 90 Day Reports. Fine is paid once a year upon renewal through the lawyer his company uses.

IF you wait and report after your next entry and the Immigration Officer fines you 2.000 Thb it does NOT help to show Facebook comments made by anonymous animals.

Gamble and see what happens.
