Second Entry on Workcation DTV - Late 90 day report

Plan to re-enter at BKK.

As others have said, right now it doesn't particularly matter. Immigration at the border do not look at this. If you never need anything from immigration in country you may be able to just never do them at all. Personally, I am going to do them regardless, as it is still a legal requirement and there are other things that used not matter, but then started to matter. (Like overstays- you used be able to just pay the fine and as long as you paid this it didn't matter if you were overstayed for years. Now that matters a lot, and overstay history can matter if applying for a new visa.)

I really dislike responses about not to worry and how immigration doesn't care. I like to do things the proper way. Either get your 90 day report done on time, or leave the country before the initial 90 days so that it resets when you return, so you wouldn't need to do the 90 day report.

The agent who put together my DTV, told me not to worry about 90 day reporting. She was right. I just flew back in after 2 weeks away and given another 6 months no problem. No questions asked.

Okay let's sort this out

IF you fail to do a 90 day report on time and leave the country NOTHING HAPPENS, not when you stamp out (because officers at passport control don't care if you EVER did a 90 day report as it's not their job) AND not when you stamp back in ..

Now if you GO to an immigration office more than 7 days after a 90 day report is due to file one you will get a 2000baht fine and you will get a failure to file a 90 day report on time fine paid stamp in your passport

BUT

That stamp WILL NOT AFFECT YOU AT ALL, exiting or entering the country, ever..

So if you missed a 90 day report and exited the country you're fine

AND

if you filed a 90 day report late and got the 2000baht fine/stamp you're also fine.

Ok. So ... If I understand correctly, there is no point to do the 90 day reporting for someone on a DTV that plans to exit Thailand within the 180 days they get per arrival. Assuming you have no other reason to visit immigration office while in country.

nope that's not what I said,

That there is no penalty if you fail to do it and exit the country does not mean you're not "obligated" (by the terms of your visa/extension) to file

However your theory is correct, IF you have no reason to go to the immigration office during your stay and you leave, nothing will happen to you.

Now is it following the rules as they're written, no, but it is what it is 🙂

my concern is that if they ever plan to penalize those who abused this system in the past, it can be troublesome. The DTV is relatively new and it just feels like playing with fire by doing this tactic. 🤷‍♂️

this happened multiple times retroactively already in thai visa history.

Like education visa and short overstayers are effectively banned from applying for Pe Visas etc.

If you are on a work DTV how can you be so disorganised to not keep up with your immigration status? You're asking for problems. Enter these things in your calender mate, keep good status with immigration! All the best.

i don't believe that for a second. I know someone who gets yearly extensions based on retirement every year at the immigration office.

They show up, file ONE 90 day report (late), take the 2000baht fine, get the failure to file fined 2000baht stamp, then apply for their yearly extension and after that never go back to the immigration office the rest of the year

The next year they do it again, file a late 90 day report, take the 2000baht fine, then apply for their next yearly extension. They've done that 10+ years and have PAGES of failure to file 90 day reports on time fine stamps in their passport. They exit/re-enter the country on re-entry permits without any issue at all.

Those stamps don't hurt you in the least

Border officer does not check the previous stay 90 day report or TM30 …. Only immigration office inland when renewing or extending the visa which is irrelevant to DTV as you have to leave at next 90 day report in any case (visa valid for 180 days only).
