What can my friend do after being denied entry into Thailand on a visa run?

hello

my friend got denied at bkk on a visa run to cambodia and is currently at the airport, he holds an argentinian passport and was in country 2 years up to the visa run, he had education visa and covid extensions, is there anything he can do? any suggestion as to coming back?

also FYI there are several people in the same situation at the airport, they are being extremely strict.

I deleted a few comments. Sorry but Thailand has long term options to stay legal in Thailand according your purpose of Stay. As mentioned earlier for those who do not have to work there is the Thai Elite Visa, for those who work and it does not matter what name you give yourself, the Non Immigrant B visa.

People get denied entry, it is part of the job of Immigration at an Airport., it happens world wide, but USA, Canada, Australia and UK even made a serie about it to be watched on youtube.

Be careful and if you hear that your friends is denied, try to get some information before you post, it saves a lot of discussion from people assuming what happened. Thanks.

I will bet that 100% on his denial of entry stamp it will say in thai "ไม่มีปัจจัยยางชิพ"

That is NO PROOF OF FUNDS.

It is the ONLY reason they can officially use, there is no rule about onward travel, proof of lodging, OR that you've been in thailand too long either 😮 just the no proof of funds clause

AND

you cannot use a bank account, credit card, online statement you show CASH (20K baht or the equivalent)

he is spending the night at the holding “cell” in the airport, possibly going back to cambodia today and maybe in a week or 10 days go to phuket thru singapore as to avoid bkk…

a tourist visa gives him 60+30= 90 days... His Argentine passport gives him 90 days on arrival

Toss a coin..

But be sure he has flight out of Thailand one way ...say to Singapore or Vietnam in 89 days. Are cheap...

ON denial of entry the person is given the choice, go back to the country they just flew in from, go to any country they can legally get in to OR go back to the country your passport is from. (It'd deportations that only let you go back to where your passport is from).

Also on denial of entry, the minute you sign that paper in thai it says you admit you're being denied entry and you're DONE,

You waived your right to file a written appeal.

Just so you know the appeal process of a denial of entry takes 3 WORKING DAYS to go thru meaning that this person is gonna sit in IDC at the airport until next WEDNESDAY if they file a written appeal.

One last thing if you don't sign the paper they still send you back to where you came from but they don't put a denial of entry stamp in your passport, (it's just in the system) whereas if you do sign that paper you get a denial of entry stamp in your passport.

As people said, Phuket, OR Chiang Mai would be the places to try to get in and they should be TOTALLY prepared with the proof of funds, proof of onward travel (in 90 days seeing as they're argentinian) and proof of lodging.

I've been denied entry years ago at Bangkok. Was treated like a criminal. Had no choice of where to fly to. Was only allowed to return back to my home country. Was escorted on and off each flight, attendants apologizing to me all the way, saying how this shouldn't have happened to me. Was only given my passport back when arriving on home soil. It's hard to give accurate information when the procedures are kind of made up on the spot, depending on how the officers feel. Refusal for entry: couldn't show the 3 requirements. That's it. So why did I get refused return to any destination of my choice? It was just a refusal of entry. Why did I get treated like a criminal, rendering everyone else perplexed and apologizing?

Okay first and last warning, STAY ON TOPIC or don't post.

Also the fact that you "spend money here" doesn't cut any ice with immigrations so stop beating that horn and tooting the drum like some how your contributions to the country overall mater, plain and simple they do not.

We have seen denial of entry more and more since the countries nearby have opened up. ESPECIALLY from people who;

- milked covid extensions the last 2 years and thought they could just keep on staying..

- only bounced out and back without taking time to get a visa before they came back,

- didn't have 20K baht proof of funds IN CASH

- didn't have proof of onward travel <- to the country your passport is from is best,

AND

- didn't have proof of lodging for their stay.

If your friend has a Thai relationship.(friend or partner) call them and have them chat with Thai Immigration Officer to try to obtain permission to enter.

nope...will not help. The new Thai immigration software upon arrival ...you are identified by facial recognition, fingerprints and complete past history of enter and exit is shown.

Including any other passports used.

I did that three years ago (I mean calling my friend pretending to be my gf). She even cried a little. They stil didn't let me in ;). I thought Covid thing and little to no tourism would have changed the government mind about expats but well... TIT.

we have had mixed reports of past success from the telephone calling.

But he has already been denied.

If he had a Thai wife or Thai child may have been allowed to enter.

thanks so much for the info, more than helpful... at one point they were telling him he had to stay at the airport for 3 days if he wanted to return to cambodia (also my suggestion) or he could leave right away if he left for argentina, made no sense...

i will keeep you updated.

reality is its a crapshoot.

If he signs anything...he will be leaving.

If he does not sign he will held in the IDC Immigration Detention Center for several days til hearing before a Judge.

Either way..bye bye Thailand.

Best for him to decide now...

Return to Cambodia..

Suggest the friend stay in Cambodia a week...then try to reenter Thailand at Phuket...not BKK Bangkok as BKK is reported to be strict ...some allowed to enter...while others being denied as seen here.

...was your friend seeking entry visa exempt?

...did the friend try a quick turnaround run same day or next day to and from Cambodia?

... Or did he get a tourist visa in Cambodia?

...or as Argentine passport holder with bilateral agreement?

...was your friend asked to show 20,000 Thai baht in CASH or equal currency ?

...were they asked to show proof of ticket leaving Thailand in 30 days ?

...were they asked to show proof of address booking for Test N Go stay and the booking address after the Test N Go stay?

hi james...

yes he was attempting to enter thru a visa exempt, he did a 1 day turnaround (i told him stay a couple more days, he didnt), for cambodia he entered on a evisa, he did not apply for a thai visa as argentines are exempt, he showed his thai bank account with more than enough money, they did not ask for proof of departure, he had the approved thai pass and showed them with all the requirements that the thai pass asks for.

he said in his flight about half of the people were on visa runs and about half of them were in the same situation as him...

The reality is that most people cant afford it, thats why its “elite”… but can still contribute a lot of money to the local economies just by daily expenses…

So many people that were clearly not genuine tourists, and I'm not surprised that they would be much more strict. Interesting that the minute Cambodia opens, there is such a mad rush to do visa runs there. Probably wasn't wise to think that immigration wouldn't notice.

and should not have tried to enter BKK as they have been reported as denying entry to those who have lived and used many extensions in Thailand.

Try Phuket , Samui or Chiang Mai to enter. No reported denied entries their...yet.

First the person you're referring to wasn't deported :O Because to be deported you have to be stamped IN to thailand. They were denied entry.

The fact they had a previous overstay had NO bearing at all on them being denied entry. It was because they did not have the 3-proof-ofz...

Even IF you have a valid visa for thailand in your passport IF you are asked by immigrations you need to show proof of funds, onward travel and a lodging.

Very rarely will the immigration officers void those requirements (and usually that's only for people on long-stay type visas or extensions).

A person denied entry is held at IDC at the airport he flew in at until he works out with his carrier where he will go.

The immigration officers do NOT care in the least where you go to, all they tell you is that you can't enter thailand. It is between you and your air carrier where you go back to. Some let you fly back to where you came from, some let you fly anywhere they fly to and some make you go back to the country your passport is from.

I think you kind of answered yourself why they would deny him. He's stayed in the country for 2 years and thought he could leave on a visa run and be allowed back in when he clearly isn't a tourist.

the US has a 10 year multiple entry tourist visa good for six months per entry.

The Thailand elite visa is vastly more expensive than a retirement visa but the country is fine having people stay as long as they are over an arbitrary age.

As Pui says, Yes there is a long term tourist visa for those with money and want to stay long term: Elite Visa. It is not cheap, but you can stay for 5 years if you like. Another option is to get a business visa. Also.looks.like there will probably be some sort of digital nomad visa in the near future. Stil being ironed out

I wasn't aware of the masters degree part. Although that is not confirmed yet anyway, and I would doubt it will be a requirement for those just working online. I did read though, that the proposal for the cost of this visa is 10k Baht per year for a 5 year visa, and then a further 5 year extension. Not bad for those who can get it...!

But lots of countries don't have long term tourist visas. Actually, more accurately, almost no countries do. Tourist visas aren't intended for long term stay. Just try staying in the USA on a tourist visa long term. As for a visa category for someone who has the money and doesn't need to work, it does already exist. It's call the Thailand Elite visa. Several people I know including my partner have it. We played by the rules for someone under 50 that wants to be able to stay long term without hassle.

That same argument could be made against any country that requires a visa or special permission to enter, which is most of the world for certain nationalities. Get the right visa for your intended stay. If the US denies your visa (as they do all the time for many people trying to get visas to enter), can the person just scream indignantly that the US doesn't want their money? That's a silly argument to justify allowing people into a country if they don't meet the reason for the entry they are seeking.

Why are you trying to sound like I made any judgement about whether he should be allowed in? All I did was say why immigration would have denied him. He's clearly not a tourist, that's all I am saying, and he tried to get away with entering by an entry intended for short-term tourists. He didn't qualify and is hardly the first person to get in trouble with immigration for this. As I see the moderators of this forum always repeat: "get the right visa for your intended purpose and length of stay." Who said anything about wanting him to spend his money here?

argentines normally enter on a 90 day exempt. no reason given, just denied.

If they don't sign anything, they can ask to see an immigration judge to make the final decision. I believe once they sign anything they're out of options and must leave.

This is based off a comment I saw recently from one of the mods so I don't know any details about the process.
