What are the residency and visa requirements for my foreign husband staying with me in Thailand?

Hello 🙂

I have three questions regarding my foreign husband styaing with me in Thailand. Please help advise whether I understand the matters correctly.

1. Regarding notification of residence, if I am the one who rents the apartment (only my name on the rental contract), I am the one who is obligated to do the report for my foreign husband who stays with me, right? Is there any difference or pro and con of having his name on the contract as a rentee too?

2. To get the residence certificate in order to use it to open the bank account for a foreigner, it’s not the same process as “notification of residence” right? Do I understand correctly that after notifying the stay of my husband which can be done online, I still need to go to the Immigration Office to get the document of residence certificate?

3. My husband has entered Thailand with 90-day non-O visa which will be expired on 4th July. After spending 12 days in quarantine, and moving in to our new place, we will be able to do all that required + putting 400,000 baht in the Thai bank. Letting the money stay for at least 2 months, we will have approximately just 5 days before visa expiration. Will that be enough days to apply for a-year extension or would you suggest we apply for 60-day extension first and then do the one-year later?

The person who should register your husband should be the property owner. IF you're in Bangkok, you can self file a TM30.

That is correct. However, I believe it requires a TM30 to be submitted to the immigration office before a resident certificate is issued. Some banks require this certificate, some don't.

Your husband entered on a single entry Non-O visa based on marriage to a Thai national, which was used. He can stay until the "admitted to" stamp, which is not the same as the "valid to" date on the visa. He has 2 months to season the 400K THB.

IF you need extra time to season the funds, he can file a 60 day extension of stay based on visiting Thai Family, which will give him some extra time.

Could you please explain more on “self file TM30”? Does it mean my husband can do it by himself? But still the document of the property (either a copy of household registration or a rental contract agreement) will be needed right?

you do TM30 self-file as a rentee, for your husband included as a person who lives that address.

Unfortunately, in Bangkok, you cannot get residence certificate from the immigration office until you submit at least one 90days report.

Get one from his embassy if you need.

REPOST: Self File TM-30 BANGKOK ONLY.

This is the way you need to fill out the TM30 form if you are filing with NO documentation from your land lord

Your name goes at the top of the form, your address goes under it, then your address AGAIN as the address where the foreigner lives.

In the blank area at the bottom left hand side of the piece that they will tear off and give back to you write your address again.

On the second page (the table) put all your information.

You sign BOTH forms on the signature lines. Print the forms correctly. the first page is portrait orientation and second page is landscape orientation :O

Make copies of;

-lease

-data page of your passport

-visa (if you have one)

-extension (if you have one)

-entry stamp

-TM6 departure card

sign the copies of your passport stuff.

This is a way to file a TM30 in BANGKOK without any information from your land lord at all. <- (meaning you don't need their i/d, their house book listing, a power of attorney form with the 10 baht in tax stamps).

AFAIK: this ONLY works in Bangkok but I can say with 100% accuracy that it does work (y)
