Me and my family are moving back to Thailand. We originally came during the Phuket Sandbox. We switched over a tourist visa to a work visa my husband got a job teaching.

We're coming back to the same job after a year of being out of the country.

His job is saying you can no longer switch your tourist visa over to a work visa.

We're also unsure about the requirements for the criminal background check as we're currently in Mexico. And it states your country of residence and we've been in Mexico a year. This is our country of residence. So do we get a criminal background check here in Mexico, or do we try to get an FBI background check from the United States, or do we apply for a police background check in Thailand?
Answer summary
A family is relocating back to Thailand after a year abroad and faces challenges in switching their tourist visa to a work visa. Their employer claims switching is no longer allowed in-country, which could necessitate obtaining a new visa from outside Thailand. The family is also confused about where to obtain a criminal background check, currently needing clarification on whether it should come from Mexico, the United States, or Thailand, and if it needs authentication.

So, the visa bit was more or less answered: anyone *can* switch from tourist (or visa exempt stamp) to a non-b but it's really up to the employer and whether they're willing to do the in-country switch -- most schools do prefer to send you out-of-country on your own dime -- noting that now it's done online and this sometimes can create problems with timing but that's between the employee and employer.... It is totally reasonable to expect to have to go out for the non-b visa and return though, nothing particularly crazy about that

...the second part, about police check, don't overthink it

I'm Canadian and I had a police check done online and sent to me, should be very easy and not more than maybe 50 bucks. This should work for your first background check as you've been living out of thailand it can't be from Thailand (it needs to be from your home country but it doesn't need to be an "FBI" or overly complicated/official thing (online is more than sufficient to say you have no criminal record)

After 1 year of teaching, for any consecutive years after that, the police check will come from Thailand (the province where you end up living and your husband's school will tell him how and where, and it will need to be done every year for each year he renews his work permit)

Standard practice in Chiang Rai is to get cheap local police background check which takes like two weeks, then travel to Laos to get teaching visa. Normally the school does all the work for this and communicates with you.

they'll provide all the documents but there's some documents that they cannot get such as this criminal background check.

Donna Olivares i had to get that myself too, but locally in Thailand at a certain police office was cheap and quick, that might help ☺️

I worked for universities, Bangkok Post, secondary schools, but the procedure was always for me, get the documents prepared by the school, and recently the police clearance, make appointment at embassy in Laos, go to Laos, get visa, pretty easy and straightforward, this probably does not fit your situation since you are outside the country, but inside the country easy :)

ok... Do you need it when you apply for the visa on the e visa website? We're outside of Thailand trying to apply.

Whether or not you can convert from tourist to non-B inside of Thailand is completely up to your employer. It requires a massive amount of paperwork to do an in-country conversion, and many employers cannot or will not go through the trouble. The vast majority of employers require you to get the non-B from a Thai embassy outside of Thailand, which requires significantly less paperwork.

The background requirements are whatever the place requiring it says they are. Is it the embassy requiring it? What does that specific embassy say? Is it an immigration office requiring it? What does that specific immigration office say? Etc.

we got the requirements from the Thai immigration website and it says country of residency. But from Google searches it states an FBI check from the United States and it has to be authenticated? And then from more Google searches it states that a police check from the Thai police force will also work. So we're really confused because right now we're located in Mexico and we do not know how to get a FBI check.

Robert Moldashel I have been all over the FBI website. 😂 There is a place that does fingerprints in Mexico City. They can get the FBI criminal background check but my concern is that the Thai government is going to want it authenticated which that is something that has to be done at the state department in Washington DC and it has to be mailed in and there's issues with mailing even letters to the United States.

Donna Olivares use embassy you're applying at, not Google.

Lynnette Munoz here it doesn't state if it's an FBI check or is it your residency country or if the document needs to be authenticated

Donna Olivares If you're from the US, you can get an FBI background check from identogo or the post office. We got ours from identogo and received it same day.

All visas embassy visa applications are submitted online now, but they are still processed by whatever the local embassy is for the location you are at. So the policies of that specific embassy are what determine what the requirements are.

OP
Lynnette Munoz that's the thing here in Mexico the Thai consulate/embassy refers us to apply through the e Visa website for all visas and I'm trying to get the paperwork in order.
