Hi all, I noticed this post [members only]/ from about 2 months ago, but I would like to ask what are the requirements for applying first time around, not for extension. I just re-entered Thailand today on a 60-day visa exemption. My Thai child will be born in a few weeks. Can I apply inside Thailand (Udon) or do I have to apply at Vientiane? Can I go from visa-exempt to Non-Imm O based on Thai child? Will it take the form of an initial 90-day visa, followed by an extension for the year? How long does 400,000 THB need to be in the bank for? Any other requirements specific to the first time application? Many thanks! ๐Ÿ™

TLDR : Answer Summary
The original post inquires about the requirements for applying for a Non-Imm O visa based on the upcoming birth of a Thai child while currently holding a 60-day visa exemption. The user is uncertain whether to apply in Thailand or at a consulate, the process for transitioning from visa-exempt to the Non-Imm O visa, and the necessary bank funds. Comments emphasize the importance of marital status, outline the need for parental rights recognition, and provide advice on potential extensions and applications either in Thailand or at a nearby consulate.

If you will marry the child's mother I'd say seeing as you're on a 60 day free entry (visa exempt) stamp now;

1 - take the one 30 day extension you're allowed,

then if you need more time

2 - take the one 60 day visit thai family extension.

That's close to 5 months to get married, get the funds in order, and either apply for the Non-O visa in country then OR go to a thai consulate in a nearby country to get one and then go for the year extension based on marriage to a thai

that's fantastic info! Thank you! May I ask how long the 400k needs to be in the bank both before and after, if applicable, for both Thai child or marriage visa initial applications and then extensions? ๐Ÿ™

marriage to a thai the funds for the yearly extension need to be in a thai bank account in your name only for 2 months before you apply for the year extension.

In theory there is no seasoning for the funds to apply for a Non-O visa in country at the immigration office BUT check with your office

to clarify, applying at a Thai Consulate nearby (Vientiane) for a 90 day visa the 400k THB could be in a Thai bank account or the equivalent amount in another bank account, BUT applying at Udon Immigration it must be in a Thai bank account only, right? ๐Ÿ™

correct, two completely different governmental agencies

outside the country the visas are sold at embassies run by Ministry of Foreign Affairs, they set the requirements

inside the country visas/extensions are done at immigrations run by the Immigration Division of the Royal Thai Police, they sent the requirements

When a thai child is born here to an unwed mother (makes no difference what nationality the father is) the thai mother gets 100% of the parental rights.

Doesn't matter that your name is on the birth certificate, that does not convey parental rights, so you can't use "parent of a thai child" to get either the 90 day Non-O visa or the year extension after that at the immigration office inside thailand

You either marry the mother (when even after the child is born you get automatic parental rights) OR you go thru family court to get parental rights by court decree

Now with that being said, these would be your options

You COULD get one 60 day "visit thai family" extension at the immigration office where you live with just your name on the birth certificate, the mothers i/d, house book etc, and 1900baht.

AND

You could go to a thai consulate in a nearby country and get a 90 day Non-O visa based on being the father of a thai child by using the birth certificate, the mothers i/d and house book and showing 400K baht in a thai bank account in your name only (or the equivalent in an account in your country)

before we get in to the other questions you asked we would have to know if you are married to the thai mother or not.

you're referring to the child not being legally mine until we are married, right? Does it make me ineligible to apply? The supervisor who questioned me about why I was entering visa exempt at Nongkhai this morning never mentioned we needed to be married when she advised/ordered me to apply ๐Ÿ˜‰...maybe it slipped her mind..

the officer at passport control when you stamped in has NOTHING to do with issuing VISAS at the immigration office where you live

We were going to wait until after the baby is born. Does that make a significant difference to the application or eligibility?
