TLDR : Answer Summary
The procedures for obtaining a long stay visa in Thailand if you have a Thai child depend on your legal parental rights. Simply being listed on the birth certificate of a Thai child does not grant you these rights for visa purposes. To qualify for a long-term extension based on parenting a Thai child, you must undergo a legal process in Thai family court to have your parental rights officially recognized. Without this decree, the best option available is a 60-day family visit extension, not a long term visa.

it's nothing personal we decline a LOT of posts which we usually provide the answer in the notes on why we declined it

As I told you if you haven't gone thru family court and gotten the "legal parental rights" decree issued (a process that takes about 6 months to do if the case is uncontested <- as in the thai mother is okay with it) you can't use being the parent of a thai child born out of wedlock to get a yearly extension.

Having your name on the birth certificate, even if your child has a passport from your country does NOT give you legal parental rights in thailand to use the support of the child as a means to stay here on a long term (yearly extension)

You can get a 60 day visit thai family extension, that's it.

SO if you're wanting to switch from being on a retirement extension to one based on raising/supporting a thai child you and your child's mother need to go to the local family court in your province and see what's involved in filing a parental rights case.

100% correct - "legal parental rights" is ใบรับรองบุตร (bai rab rong bud), which is the main requirement. As Tod said, you get it in at family court with help of lawyer, or amphur can issue if your child is a certain age. We have just completed this process by following Tod's advice so thank you too.

another way to get granted legal parental rights is via the Amphur decree, but the child has to be over 6 y/o (some Amphurs want them to be 8 y/o)

So if your child is over 6, go to your local amphur (where they are registered in the house book) with the child's mother and see about how it is done.

No legal parental rights are a problem. Seek the advice of a Thai legal professional if necessary.
