Does anyone have experience making the guardian visa? I have a 2 year old son with Thai mother. What is the best way to obtain it?

Okay, IF the O/P has a half-thai child out of wedlock he doesn't have ANY parental rights. It doesn't matter if he has his name on the birth certificate or if the child has a passport from his country or not, according to thai law he has NO parental rights.

Unless he goes thru family court and gets recognized as the legal father he cannot get a 90 day Non-O visa OR a yearly extension of stay inside the country at the immigration office.

All he could do is get a 90 day single entry Non-O visa from the thai consulates in Savannakhet or Vientiane Lao. They don't require proof of any funds, just the birth certificate with the father's name on it, the thai house book listing of the child and the thai i/d of the mother.

He'd get stamped in to thailand for 90 days on that visa and he could apply for a 60 day extension of stay based on visiting family at the immigration office for 1900baht.

OR

He could go to the thai consulate in Penang and get a year-long, multi-entry Non-Immigrant Type O visa. That would require 400K baht in a thai bank BUT there is no seasoning requirement on the funds. On that visa he would get stamped in for 90 days, when that was running down he'd bounce out and back into the country to get another 90 day stamp. He'd do that for the validity of the visa itself and could get 15 months of stay out of it.

You should be ok with that and the birth certificate with you on it. Make sure at least 400 000 on your account for last 2 months. Never less

that is not correct, you cannot get an extension of stay inside the country with just your name on the birth certificate

They told me 400.000 baht in thai bank account and legalized paper from thai lawyer that i have the same custody rights as the thai mother and supporting my daughter financially. This i what the chief told me at immigration here . But... as it is well known, it mightbe different in any province
