My wife and 2year old child is in S Korea, planing to entre Thailand Jan/Feb.

I'm in Chiang mai, will receive an "O"visa next month, then i'll apply for a long turm visa based on Retirement.

My question is, what's the best approch or options for my wife and child in reguards to long stay visa?

I edited my comment about having the child come in on a 90 day visa exempt as koreans don't get that since last year and it's just 30 days now.

Still doesn't change my thought that you can bring the child in on a 30 day visa exempt, let them overstay, (for years if you want to) without any repercussions.

now whether the school you will enroll them in with have a problem with it or not, is between you and the school

I will add ONCE the children start overstaying past their entry stamp there is no way to get them an in country visa from the immigration office. The only way would be to exit/re-enter and start over

i do have one more question, once my wife gets a NonO visa in S korea, thus connect with my retirement visa.

What documentation should she need?

Wedding certification in english, certified by korean/Thai embusy ?

as soon as she gets here on the 90 day Non-O based on being married to someone on a 'retirement visa' you BOTH need to go to the immigration office in your area to get the list of required documents that show what you need so she can get an extension 'piggy backing' on yours (called Trailing Spouse Extension)

honestly I'd wait until your wife is here and you have her passport, and all the documents to take there together so they can look at them and tell you if any of them need 'certifying' at the korean consulate

BUT that's just what I'd do, because then they KNOW what it is you're trying to do, where as you going without her trying to communicate in mime, charades and pidginengrish might not get the whole point across :)

ive passed what i have learned from you to my wife, personally i'd go with what you have said, But, wife knows of a couple that got fined with an overstay kid. (I don't know the details) so she is going to apply of an NonO visa for herself and our son.

However, she said that if it's difficult getting him a visa, she will get a nonO visa for herself and a 30day on arrival fof our son

My wife and child are applying for their non O visa's.

I told her about your recommendation about the childs visa, i like your recommendation

However, her concern is schooling, maybe school not happy with overstay visa is the child entres on only a 30 day visa (visa excempt)

Do you know of others that have done this?

I know many people who have foreign kids in school that have stayed years past their entry stamp. As I said children under 15 cannot be fined for overstay and children under 18 can't be banned.

have your wife apply for a 90 day Non-O visa based on marriage to you (a holder of a retirement visa), <- to do that you'd have to get your Non-O first which seems like is what you're doing.

She can't get a Non-O issued in country for being married to someone on a "retirement visa" so that's her only option.

The child I wouldn't even do anything about and just bring them in on a 30 day visa exempt <-(since the lock down last year koreans no longer get in on a 90 day visa exempt entry , they get 30 instead) and then let them overstay.

There are no overstay fines for children under 15 and there are no overstay banning for children under 18.

she'll apply for a 90 day Non-O visa based on marriage to a foreigner who has a retirement visa (you send her copies of your data page of the passport and the Non-O visa/extension)

Then she'll get stamped in for 90 days during that time you both go to the immigration office and get the information on what's required for her to get a matching extension based on "trailing spouse" <- married to a foreigner on a long term visa/extension/

The child will be fine and you won't have any issues at all exiting/re-entering.

I don't want to make a mess, but just a thought.

While your children would be fine to just enter/exit Thailand when they are overstaying (only just get an overstay stamp on their passport), if you are seeing them enroll in school in Thailand, you may want them to be here legally.

If this is the case, have your wife check with the Thai embassy in Korea if they can get Non-O dependant on you like yours.

Or, if they have dual passports, make sure to let them enter on visa-exempt (not on visa waiver/bilateral agreement with Korean passport even it gives you 90days), because visa-exempt entry stamp can be converted to Non-ED for example, but entry on visa-waiver cannot.

I'm a little confused, visa-exempt and visa-waiver, isn't that the same. entry into Thailand that does not have to apply for a visa, in Korean , they will get 90days. Good point about overstay stamp in passport while enrolling in a school, could complicate things

, (modified) visa-exempt scheme and visa-waiver on bilateral agreement are different program and defined separately.

Both has possibility to apply for in-country visa. Sorry for my mistake before, confusing you.

But If someone enter Thailand on bilateral agreement (visa-waver), may not be able to apply for extension.

Some international schools wouldn't let students enroll if they are overstaying.

Looking at the image, i knoticed that S Korea is no longer have 90 days, i was thinking it was an error.

But when i looked down the page i found

Suspension

for Korea (ROK)

from 13 April 20

onwards.
