TLDR : Answer Summary
The user inquires about the best visa option for a 49-year-old single parent with a Thai child. The responses suggest applying for a Single Entry Non-O visa, which allows a 90-day stay. If the user has parental rights, they can subsequently apply for a one-year extension based on raising a half-Thai child. It is recommended to gather required documents from the immigration office before applying for any extensions.

okay, IF you are going from an extension of stay based on employment to an extension of stay based on raising a half thai child (that you have parental rights to) you would get documents from your employer, cancel your current extension of stay and immediately apply for a new yearly extension based on raising a half thai child.

MY advice is GO to your immigration office and get the hand out that lists the requirements (documents, photos, bank letter, bank book, copies, etc) you need to apply for the raising half thai child extension so that when you do stop work and go cancel your current extension you can apply for the other extension right then.

The correct visa you would use is a Single Entry Non-O visa based on raising half-Thai child. This would let you stay in Thailand for 90 days.

IF you are granted parental rights, OR you were married to the mother at any time, you can apply for a one year extension of stay based on raising half-Thai child.

have you been granted parental rights fro the child?

AND... look in your passport - do you have an extension of stay, OR a non-B visa?

@Marcello ********
do you mean you are still in the first 90days or you already applied for an extension at least once?

@Ellie ******
more than once... I'm here since 2005

@Marcello ********
then my comment below is based on you being on an extension of stay based on employment and NOT the 90 day stamp you get when you get a NEW non-B visa.

@Marcello ********
So you may be able to change the reason for the extension of stay.

I would ask your immigration office. My advice is this (assuming you're still on your original 90 day stamp):

1. TRY to apply for a one year extension of stay based on raising half-Thai children. You will need:

To get a one year extension of stay based on raising half-Thai children, you will need the following:

1. Your passport and a copy of:

- Your data ("picture") page

- Your Non-O visa

- Your entry stamp

- Your departure card

2. Your child PHYSICALLY next to you, and

- Her ID card and a copy of her ID card (OR passport, OR houseboat)

- Her housebook, and a copy of the first page

3. To meet the money requirements, which are:

- 400K THB in a Thai bank account, *NO SEASONING REQUIREMENTS) OR;

- 40K THB in income OR;

- a letter from your embassy saying you make 40K THB a month

4. Proof of custody rights (either the rose border certificate, OR a translated copy from your home country OR court documents showing parental rights)

5. The application form

6. 2x passport pictures

7. 1,900 THB for the processing fee.

Different immigration offices have different requirements, and this may include:

- A copy of the TM30 filed where you live

- A hand drawn map to your house

- Witnesses or interviews with neighbors

- Rental contract (if renting property or a condo)

IF the immigration office will not grant you a one year extension of stay based on raising half-Thai children, you can get a 60 day extension of stay based on unable to travel due to COVID-19.

1. Your passport and:

a. a copy of your data ("picture") page

b. a copy of your most recent visa (if you have one)

c. a copy of your most recent stamp

d. a copy of your departure card

2. A TM30, filed in the immigration office.

3. The forms (each immigration office may have different forms, and ant to use their special forms)

4. A letter from your embassy saying you can not return, OR a print out from your embassy website saying they don’t issue the letters, OR a print out of a letter from the embassy saying they don't issue those letters.

5. 2x passport pictures

6. 1,900 THB.

Different immigration offices have different policies. *SOME* may require:

- The ID card of the property owner where you are staying

- Copies of *ALL* stamped pages in your passport

When the immigration offices stop selling the 60 day extension of stay based on unable to travel due to COVID-19, then you can purchase a 60 day extension of stay based on visiting Thai family. You will need:

7. MAYBE a copy of the TM30 where you live.

The single entry Non-O visa would be 2K THB in local currency (since you're buying the visa while overseas). Look at the Thai embassy website where you're located for the actual cost.

1. Are you currently on an extension of stay, OR are you still on your original Non-B visa.

2. Did you get parental rights to the child from the courts OR were you married with the child's mother before the divorce?

You can apply for a non-o visa in Thailand.

But you can not do that if you are a holder of a non-b visa normally.

But thai immigration might let you do it now because of covid19.

Go and talk to your local immigration office.

thank you for the advice

it is also a rule that if you want to convert your current visa ( or permission to stay ) into a non-o visa, this has to be done 20 days ( Varies from office to office ) before your current permission ends..

Normally it can only be done from visa exemption, or tourist visa.

But has been some cases lately that immigrants has done it from other visas ( because of covid19 )

Usually you would have to travel outside Thailand for applie for it but they do make exemption.

Good luck.
