STUDENT AND GUARDIAN VISA

Good Afternoon,

My husband, two children and I are currently living in Bangkok. My husband is employed and therefore has his WP and Visa. My children and I are here on Non Imm O Visa’s.

My husbands contract ends in July, as does the WP and Visa’s we have and as it stands there is no employment on the cards. However, we would like to stay in Bangkok for 1 more year to allow our eldest to finish primary education.

School have said that they will prepare dossier and other documents required for Student Visa but does anyone know how long this takes to process... Time from application to actually completing/obtaining the Visa?

My husband and I would like to stay on guardian Visa’s and we understand the requirements - 500K baht each in an account for 3 months prior to application etc. Again, does anyone know how long the process takes? Can we apply for this from Thailand or do we need to leave the country? Are we able to apply for this while having our Non Imm O Visa’s or do I need to cancel these first?

Thank you in advance to any advice.

TLDR : Answer Summary
The poster is seeking information about the processing time for obtaining Student Visas for their children and Guardian Visas for themselves while living in Bangkok. They currently hold Non Imm O Visas due to their husband's employment, which is ending soon, and they wish to stay in Thailand for another year for their child's education. They ask if they can apply for Guardian Visas while holding valid Non Imm O Visas, and whether the applications can be processed within Thailand or if they must leave the country.

Please check again... I don’t think 1 kid can have 2 guardians.

You can not change from a Non Immigrant O visa to a ED visa inside the country. BUT if you are inside Thailand on an Extension of Stay and doing the 90 day reports you can change the reason of Extension at local Immigration Office. The big question than is: Are you all on a Visa and doing border runs every 90 days or are you all on an Extension of Stay?

Your husband has to cancel his work permit and his extension of stay on the last working day and than he can apply for a new Extension of Stay based on being a family member of an alien who has been permitted a temporary stay in the Kingdom

for study in an educational institution

If you can change (cancel and apply for new) the reason of the Extension of Stay based on study, you can directly apply for a change (cancel and apply for new) of reason for your Extension to stay for being a family member of an alien who has been permitted a temporary stay in the Kingdom

for study in an educational institution

Thanks, this means you are all on an Extension of Stay. If the school has all the documents finished and this must be done before the end of July when the contract and work of your husband end. You can visit the Immigration Office and ask to change the reason of Extension of Stay as dependent for your oldest child to Extension of Stay based on study. If this is not possible you have to leave Thailand with the oldest to apply a new visa, The Non Immigrant ED visa for him/her. .

@Robert ******
currently my husbands work sort out our Visas. If we haven’t left the country in 90 days then we just hand our passports to HR and they get the Visas renewed. We have never had to a do a Visa run or visit a visa office. Albeit I think only once in 2 years have we not left the country within a 3 month window.

I got a non-o visa in Chicago by showing them documents from the school and my daughter's birth certificate proving the relationship. Before the 90-day single entry visa expired I went to Samui immigration with proof of funds (bank statement and bank guarantee), documents from school, Google map with gps coordinates of our house and again her birth certificate and we were both issued a one-year extension the same day.

I don't know if you need a new Visa or can extend the one you're already on.

That's how it worked for us 🙏
