How can we extend our non-O and non-B visas in Thailand?

... Hi everyone, hope this is not an annoying question, but I need advise or suggestions! My husband has a non-b and work permit in Pattaya. He has his own company selling South African Biltong. I have a non-o visa, following him. Next month our first 1-year visa expires. Can we go to Immigration in Chonburi direct to extend our visas with twelve months or do we have to work through the same agent that initially assisted in his first non-b and my non-o? We are not sure about the required documentation and all his company papers are with him. Are there any doc's required from Department of Labor or Ministry of education that only this agent can obtain? Apologies if my question is inappropriate, but I need to start somewhere to find out. Greetings.

Linda, your husband could do this himself but most companies have at least a contract accountant which is actually a necessity for required monthly and yearly reports that form the basis of the required documents to get another extension of stay. In no way is a lawyer required with the exception of original company formation. Hiring an accountant by contract is a normal business activity here in Thailand. An accountant can get all original company records from the DBD (Business Department, the Revenue Department, the Social Security Tax Office and perhaps the Ministry of Labor (Work Permit). These Departments can also provide copies of all required monthly reports and payments such as the Social Security "Social Fund" tax payments made by the 15th. of each month (paid at an authorized bank normally), the Revenue Dept. will have copies of the salary tax payments on your husband's required salary (PND1 and PND91) and Company tax payment reports. You will also need a copy of last year's Balance Sheet (a required Audited financial report). An experienced Accountant can find and assemble a document packet required for a new Extension of Stay. And usually at a price much lower than what a lawyer charges (the lawyer likely hires an accountant to do this and tacks on his/her lawyer fee.)

Visit the Immigration Office and ask the hand out with requirements to apply for a new Extension of Stay based on Working for your husband and for you based on being his dependent. Start making the copies and you can apply by yourself.

yes very true, the lawyer could be looking for a second payday. My lawyer is doing my extension tomorrow at immigration, I shall be photocopying all the documents she submits and doing it myself next year. 👍

If you run your own company you should have all the documents by yourself. If you give everything to a lawyer and tell him to take care, it is your choice and then you face the risk you have to pay to get the needed copies of your own documents.

yes, they then can at least see if you need to ask their awyer for any documents he may have.

You can apply between 30 days and the last day of your permitted up to date stamped in your passport. The 1 year Extension of Stay is added to that date, so going early only makes it more at ease if you miss a copy.

Linda, it seems your husbands One-Year Extension of Non-Immigrant B Visa is subject to the following conditions (not necessarily renewal conditions):

Valid Thai work permit

Minimum salary per nationality

Four Thai employees per permit (4:1)

Must have 1M THB in net equity and registered capital of a minimum 2M THB

Must show revenue in the previous year to cover the salary of all the foreign employees. The company must submit year and profit and loss account inspected and certified by a certified accountant. The total revenue must show an amount higher than the total salary and benefits paid to the employee. It seems you need an accountant to maintain such a visa.. I suspect your Lawyer may be both. So I guess the answer to your original question is - it may be extremely difficult to renew this visa without a Lawyer/accountant 😕

ah. Just read this. It may very well be the case where you have to supply evidence of the tax records for his four staff.. not 100% if this is required for renewal BUT. If it is and you don’t have them and/or don’t know how to extract them from your local Amphur then you may need your lawyer.. Check with immigration first to see if they are needed... 😕
