Has anyone ever managed to convert DTV to a Non-O after marrying a Thai citizen? How did you do it? No luck with in-country conversion: TM86 is for TR category, and TM87 is for visa exempt - no official route or even a proper form. Immigration told me since I cannot get a bank account on a DTV, I cannot get an in-country extension of stay based on marriage (without a bank account and seasoned 400k) anyway - which sound true for a 1yr extension of a Non-O not so much for a conversion, but anyway… All the recommended visa agents I tried to contact told me the same thing: they cannot help. Advised to exit the country. Well, I did just that, as I was traveling anyway. Went to the embassy in my home country and was basically told, that since I already have a valid visa - I’ll get rejected if I apply for the 90-day Non-O, and they’re not processing “cancellation request” of any sorts. Any ideas how to get rid of this DTV?

I considered entering Thailand through e-gates despite having this DTV - that would in theory make my entry visa exempt and make me eligible for TM87 conversion. But is this even legal? I don’t want to risk being denied entry or violating the law. Any ideas?

KeenDeer1330 Hi everyone!

I wanted to share my recent experience converting a DTV visa to a Non-O Marriage visa, as I haven't seen anyone talk about this process in the group yet. 1 just successfully completed the conversion at Chaeng Wattana, and here are the steps I took:

Step 1: Cancel the DTV. Go to Chaeng Wattana and fill out the TM 86 form.

Important Tip: The staff at the front desk initially insisted that this conversion wasn't possible. You may need to firmly push to speak directly with an Immigration Officer (10).

Step 2: Apply for the Non-0 Marriage Visa. Immediately after the DTV is canceled, submit your application for the 3-month Non-O visa,

Step 3: Spouse Interview. You and your Thai spouse will need to complete a short joint interview on the spot.

Once the interview was done, my 3-month Non-O visa was approved! The entire process took about 7 hours, so plan on spending a full dav at Chaonn Wattana

Quick question for the group: when it comes time to apply for my 1-year extension next year, is it possible to use an agent so I don't have to spend all day at Immigration again? If so, what is the usual cost for a 1-year marriage extension through an agent?

1 hope this post helps anyone looking to convert their visa! Cheers

this was my post dated sep 9

Immigration are correct. Without the funds in a Thai bank account you can't apply for the conversion from a tourist visa (which the DTV is) to a Non-O visa. You also can't apply outside Thailand for another visa while holding a DTV. You would need to contact the consulate that issued the DTV and see if they are willing to cancel it, if they will you must be outside of Thailand when they do and then you can apply for a 90 day Non-O based on marriage before returning. Or perhaps it would be easier just to remain on the DTV until it expires, leave Thailand and apply for the Non-O then

I contacted the exact embassy that issued the visa, I flew to my home country and went there in person. They refused to process a cancellation request or any other requests from me, stating that all visa affairs are handled via the eVisa system, and warning me that simply filing for another visa while my current one is active will result in instant rejection.

They also refused to offer any other information or explanation ending the conversation with “you have an active visa, there’s nothing else we can do for you” - basically a gentle way of telling me off.

One of the agents also told me that even with the bank account immigration has no clear way of converting the DTV cause the form (TM
*****
) applies only to visa exempt and TR tourist visas, not DTV.

I am also not willing to wait another 3+ years to start settling and building my new life with my spouse merely because of some bureaucratic loop. What if someone needed to start working or do business in Thailand with her/his spouse to support their new-born child? Will the officers at the embassy also get ahead of themselves to prevent the DTV holder from actually obeying the law?

My question is not shall I keep the DTV cause there is no way in the world I’d ever do it, or apply for it again if I knew what I know now now. I will take all the measures required to fight it, I don’t mind flying back and forth if that’s what it takes - just to get rid of this DTV mistake and have the right to live with my loved one, and have a normal life… Actually me staying on the DTV long term with my spouse is against the visa’s purpose and I am not willing to violate the law, I want to comply. My question is: are my odds of getting rid of this thing better if I re-enter on the DTV or while I’m outside Thailand? What does your knowledge and experience tell you?

Anonymous participant if they won't cancel the the DTV there's absolutely nothing you can do other than wait for it to expire. There's nothing about the DTV that prevents you living with your wife other than having to travel for a brief period every 180 days

got it, thank you for your time 🙏. One of the lawyers suggested that my spouse should try to go in person and / or file a complaint to the MFA’s Department of Consular Affairs in Bangkok - as they’re the ones overseeing embassies and visa processing… I think we’ll give that a try, as there sadly seems to be no other options left. I’ll report if there’s any success. Thank you again 🙏

Anonymous participant you really only have one option and that's to ask the consulate that issued the DTV to cancel it as we've already discussed. You've said they won't do that so your stuck, nowhere else can cancel it. That's obviously not what you want to hear, but that's the reality of the situation.

With all due respect but you’re not telling me anything related to the question or relevant to the matter. That’s why I keep asking, because you seem to be this group’s expert: how does anything you’re saying: about the remote work, about the eligibility semantics relate to my situation? Which is clear as a day: I no longer qualify for the DTV, it does not apply to my circumstances anymore, I’m not coming to Thailand for workation, so I need it gone or converted to a proper visa. What in your experience should I do? Stay away from the country for 3,5 years? Or play the system and lie to immigration?

Anonymous participant I'm not making any point. I'm just telling you where you currently stand.

@John *********
So what’s your point? That I should misuse the DTV, which I’m no longer eligible for as I no longer work? Or that I’m effectively banned from legally entering Thailand (without lying to the Immigration) for the next 3,5 years until this it expires?

I think you’re confusing eligibility for a visa with possibility to apply but I won’t argue semantics. What is your point thought?

Anonymous participant your not perfectly eligible for a Non-O visa based on marriage as you currently hold a visa.

so you’re basically telling me there’s no way for me to enter Thailand legally (that’s without LYING about the purpose of my stay / pretending it’s different than it actually is) to rightfully live long term with my spouse, merely because I have some (as you call it) tourist visa tied to my name? And although I’m otherwise perfectly eligible for a Non-O (marriage) visa?

As I stated: I am NOT going there for workation anymore. For now I quit working altogether, cause I no longer need to. I will get a work permit if I ever need it (decide to start a business or something), but that’s totally outside the scope of my question, and a thing for the future if ever! The point is: DTV is no longer relevant for my situation, and it blocks me the way to a legal stay with my spouse, so I want to get rid of it. Your advice is to stick to it anyway, which doesn’t sound like the right and lawful thing to do.

Isn’t wanting to align my status with my actual purpose what compliance should look like? As for now to me it seems like the system penalizes me for it.

Anonymous participant if you will continue to work remotely then you need to stick with a DTV anyway. A Non-O based on marriage doesn't allow you to work remotely from Thailand

Isn’t this group all about explaining to people that DTV is NOT for living in Thailand long term? And now you’re trying to convince me that it’s okay to try to misuse the visa?

actually there is: the reason for entry. My DTV is workation. I’m not going there for workation anymore. I’m going there for the purpose of residence. That’s an immigration lie which is a serious offense I’m unwilling to commit.

My immigration office said it is possible, but said I needed a bank account. I highlighted that this is not possible to get. They told me I was wrong and that I could get one. Didn’t want to argue. Went to local banks. They didn’t imply that if I had documentation showing k had a Thai document showing plans to stay that they might give me a bank account. Will try again with marriage certificate

DTV_BegPecker yeah, too many uncertainties here though… Maybe they will give you a bank account, then again maybe they will convert your visa, but maybe they won’t… Cause nothing is codified here everything’s discretionary. DTV is the worst visa ever, honestly… so unclear, so sketchy in procedures… 😞 I’m simply wondering what to do. I’m about to go back to Thailand to my spouse in 2 weeks or so and I simply wonder: should I re-enter on this DTV and try inside the country? Or should I be more insistent on the embassy and try to scrape it and apply for non-O / re-enter visa exempt - that would at least give me a legal basis for conversion? This is so ridiculously frustrating..:.

Anonymous participant it is not a bad visa. You wanted a long term visa and that is what you got. For me, no rush. For me, I get married next month. If I can get a bank with my marriage certificate, that is great, if I can’t, no big deal. Next option, is a joint account, which will be easier under a DTV, but requires 2x the amount of money. Once I got the marriage visa, I would then open a new visa under my name, so only need to half normal amount of money for next extension. If not, will just keep DTV, already 2.5 years in, so half way through

OP
DTV_BegPecker I respect your opinion but for me the DTV is a terrible visa and I totally regret applying for it.

1st of all it’s NOT a long term visa - it promises to be but underdelivers hugely with the ban on bank accounts, current scrutiny upon entrance and no clean way to change it to an actual long-term visa. DTV is basically a multi entry tourist visa that proves to be “sticky” for the 5 year’s period it was approved for…

2. I am not willing to wait another 3,5 years to start settling and building my new life with my spouse merely because of some bureaucratic loop. What if someone needed to start working or do business in Thailand with her/his spouse to support their new-born child? Will the officers at the embassy also get ahead of themselves to prevent the DTV holder from doing so? Fortunately that is not my case, but it makes me wonder

What is your hone country? Was the original DTV issued there or did you apply elsewhere?

Yes the DTV was issued by the embassy in my home country - the exact one I’ve just reached out to, the same one that refused to process a cancellation request or any other requests from me, stating that all visa affairs are handled via the eVisa system, and warning me that simply filing for another visa while my current one is active will result in instant rejection. They also refused to offer any other information or explanation ending the conversation with “you have an active visa, there’s nothing else we can do for you” - basically a gentle way of telling me off.

I understand you've contacted the Embassy, but they're the only ones that can really cancel it. Years ago, I had an O visa that I wanted cancelling so I could apply for the B visa in Singapore, and I had a nightmare runaround. I had to pay a facilitation fee to an agent who had it cancelled. However, it was immigration who could cancel it. They wouldn't cancel it for me, though so that is why I had to use an agent. Hope you get it all worked out.

Anonymous participant Crazy. My issue was solvable as Immigration could cancel the visa. Only the office who issued it. Another location would not. The Embassy refused to process the B application while the O was "Live". I still had to pay an agent in Thailand to solve the issue. The only thing you could try is a well connected Bangkok agent with immigrstion contacts. Good luck

Thank you so much. 🙏 I will try that. One of the agents I’ve spoken to so far told me that immigration won’t help much even if I do manage to get myself a bank account, because the DTV is not issued by them, it’s a visa by the MFA and only the embassy issuing can cancel it - that’s why I ultimately decided to give that a shot. I do however believe based on my own research that you’re right and the agent missed immigration’s ultimate discretion over any foreigner’s stay in the country…

At this point however my biggest question is this: shall I re-enter on the DTV and try to deal with it from inside Thailand or should I stay in my home country and try to find an agent who will cancel my visa first, then apply for the Non-O? Can an agent even do it while I’m out of the Kingdom? What would be you advise based on your experience ?

SwiftRaspberry2631 I did just that! Went there and they told me the exact thing I stated: they do not take of process cancellation requests and they will reject my Non-O application since I have a valid DTV so there is no point in even filing
