My daughter has a Thai birth certificate and I was told she wouldn't need a visa for that reason. However, my plan was to get an ED visa for her so I can get a non-O on her ED.
Any knowledge on this scenario out there please :)

My daughter has a thai passport and I still struggle with my Visas. There must be a world wide campaign to make immigration laws more humane. Someone will comment like if you have thai daughter or son doesnt mean you get easy pass. Because a child can live without father or mother it is proven. I have got such replies lol
rules change so frequently that has me frustrated. If there was one permanent set of rules that would have been convenient. But they seem to think that changing rules every quarter makes life easy for foreigners. IRONIC

well, the rules about extensions of stays based on raising children are pretty clear as far as what's required, who qualifies, etc. It's not too tough, but it is a lot of paperwork :/

Is your daughter is a thai national? By that I mean is her mother a thai? If so, she doesn't need a visa to get into thailand or to go to school here and you should get her a thai passport before you show up here.
If she's a thai You don't need her to be on a visa so you can get a Non-O to take care of her.
You would need to either have been married when the child was born OR have gone thru family court an gotten granted parental rights so you could get a yearly extension of stay based on taking care of children here.
It requires you banking 400K baht or providing a notary letter from your consulate that you get 40K baht income per month.

No Thai passport possible as neither is Thai. I was wondering if she could still get ED visa if she doesn't even need one as she has a Thai birth certificate. But apparently ( I've been told) I should go ahead with the application anyway.
, the real rule is; children under 15 can't be fined for overstay, and children under 18 can't be banned for overstay.

Just because someone has a thai birth certificate doesn't mean they're thai nationals. I know a LOT of kids here born to foreigners here who have thai birth certificates BUT aren't thai :O

I'm not sure ofnthe original posters situation, but assuming she's western it could be similar.
My missus is sort or displaced person in Thailand, a Shan person. And I'm British, so in the top right corner of the birthday certificate, under nationality, it translates roughly to "born of no nationality". I've heared of poth parents are of some Burmese ethnic minority origin sometimes they won't give out a birth certificate at all. My name is on the certificate 3 times and I signed it, hers only once which ia also odd. He can stay untill he's 7 or he leaves the country with that ticket. Then there is no overstay penalty for under 18s, but then I suppose of he just stayed in Thailand and never applied for British citizenship then they'd have nowhere to deport him anyway ๐. He can't get a Burmese passport because he wasn't born there. And the UK passport agency are being difficult because he has no photo ID to prove who he is!!
I'm assuming I'll be able to sort out some sort of ID for him in Thailand, even if it's the "non-thai citizens ID"............

If your daughter has a Thai birth certificate then she must also have a thai passport or can get one. She doesnt need a visa, and probably wouldnt be able to get one anyway given that she is Thai. You can then get a non o on her thai passport if she is a dependent as far as I know.
