Does a 20-day visa overstay affect my eligibility for the DTV visa in Thailand?

Hi everyone,

I was hoping someone might be able to answer a question about applying for the DTV visa. I have all the relevant paperwork to apply, but after checking my eligibility at [members only], I see there may be an issue regarding overstays. I have overstayed my visa in Thailand once, for 20 days total (due to delays in my new passport arriving from the UK). Does this effect my eligibility, or are the "long overstays" mentioned those of 90 days or more? I tried calling the Thai consulate in Savannakhet, but they weren't able to provide any information over the phone.

TLDR : Answer Summary
The original poster is concerned about their past 20-day visa overstay while applying for the DTV visa. Comments suggest that embassies have discretion when it comes to overstays, with some stating that a single 20-day overstay should not affect eligibility for the DTV visa, especially if there aren’t repeated offenses. It is advised to contact the embassy directly for a definitive answer before paying application fees.

The question o long overstay is down to the immigration I.e 20 days isn’t really long as they start the penalty from the 90 day mark BUT it depends on so many factors like the reason, the amount of overstays etc , the embassy is the only place that can give a defined answer for you not anyone here

I'd email the visa section email address first, explain that you had a twenty day overstay and the reason you were waiting for a new passport to arrive, therefore I presume you couldn't of left anyway. I also presume that you declared your overstay when leaving at the airport, paid the fine and left. In my opinion it would only have a bearing on your application for a DTV if you'd been arrested by police or immigration police. I reckon once you explain in an email, you'll be ok. Better to get confirmation before you apply and pay over £200, which if refused they don't refund for failed applications.

Arrested by the police while on overstay is a 5 year ban so that did not happen

FFS, why have you sent me this comment? The person asking the question stated they'd had a twenty day overstay. more than 90 days, 1 year ban. They said there overstay was 20 days, so because the minimum on the chart you've pasted says starting at 90 days, I'd presume that anything less than 90 days would only incur a fine and no ban. Christ I need to stop using this shite.

No one can say, apply and find out.

You do know that is not an official website or test.

This website is not official. It's created by individual in Thailand

It says overstays, plural, you have one overstay and not a history (!) of overstays(!), so you should be fine.

I agree. History probably default to more than one. But Brandon is right it is the embassy responsible. FB can give an opinion which could be right. We were not in the room when requirements were written

Long + overstay(s) not just one overstay … you are just fine

I just got approved in London, I have an 11 day overstay from a year ago and they said nothing about it.

I think the difference here is that he was a bit too open about it and you just kinda…didn’t say anything 😂

It is up to the embassy's discretion.

I almost didn't allow this post, because the ONLY people that can answer this is the embassy you are applying at. Regardless of if they are replying to you or not, they are the ones that make the determination of how much is too much.
