I hold a work permit and Non B visa based on extension of stay due to employment.

I am currently stuck outside of Thailand and unable to return due to limitation of flights and the flight ban.

Can my recruiter, hold on to my work permit and not cancel it in case they decide to terminate the contract. Is there a way to retain the work permit for sometime untill I get another job and then do a transfer as I can't do that unless I am in Thailand.

Please suggest!

TLDR : Answer Summary
An individual with a Non B visa and work permit is seeking advice on retaining their work permit while they are stuck outside of Thailand due to flight restrictions. They fear their work permit may be canceled if their employer terminates their contract. The responses indicate that typically, a work permit is tied to employment, and once the job ends, the work permit is canceled. However, there is a suggestion that a good relationship with the employer may allow for some leniency.

Your work permit is tied to your job. Once your job ends, your work permit and extension of stay is cancelled. If you and your employer have a good working relationship, they may be able to not cancel either your work permit or extension of stay until you get a new job (but it's HIGHLY unlikely they would do that though).

if they do decide to so, are there any costs involved in retaining the work permit?

No. BUT... as soon as you are no longer employed, your work permit must be cancelled along with your extension of stay based on employment.

is that possible in the above scenario

Plus, if you're working as a "freelance"; how would taxes be paid?

To maintain an extension of stay based on employment, the company that he has his extension of stay from must pay him minimum wage. The minimum wage to pay depends on a person's passport, and can range from 25K THB to 60K a month (if my memory serves me right).

I don't understand. The work permit belongs to you, and you should keep it.

And if the employer decides to terminate the contract they can cancel the work permit. That's my understanding unless I am missing something

The work permit is provided by the employer basis my working agreement.

True, but you keep it, and it should be at your house. Did you give your work permit to your employer before you left?

And I'm guessing you have an extension of stay based on employment as well, correct?
