Many immigration offices will tell you they can't do it and instead send you out of the country to a thai consulate to get a 90 day Non-0. Some immigration offices weren't allow to issue them for a while (Jomtien) at all. instead you had to go to bangkok to get it done. But last I heard Jomtien can do it again.
The people who I have seen successfully apply for an in country 90 day Non-O did so for the following reasons; over 50 (retirement), married to a thai, raising children, being the dependent of someone legally working here and volunteering for an NGO or foundation.
