Can my husband re-enter Thailand on a visa exemption after a same-day trip to Ho Chi Minh?

Hi everyone,

My husband is currently on a non-b visa, his current job/contract is finished so he will leave thailand without a re-entry permit, his visa and work permit will be cancelled and re-enter on a visa exemption for 45 days.

His current visa expires on the 2nd of Jan, my question is, can he fly in the morning to Ho Chi Minh and fly back on the evening? Or is there a 24 hours rule or something?
