Entering Thailand on a 45 day visa exempt instead of Re Entry Permit. That's what l am thinking of doing. That's the question. l have the re entry permit but with timing and things changing l would prefer to enter on the 45 day visa exempt. l know l will loose my Marriage extension but that's ok . So if l point out at immigration l don't want to use the permit will they ok this ? My extension expires 5 days after l arrive so if l didn't renew the extension l would be on over stay and of course l don't want that.

TLDR : Answer Summary
The individual is considering entering Thailand on a 45-day visa exemption rather than using their re-entry permit. They are aware that this choice will result in losing their marriage extension but prefer it to avoid overstaying. Comments indicate that success may depend on the immigration officer at entry. Some advise to wait for the extension to expire before entering to ensure being granted the visa exemption, while others suggest that if they get stamped in on the re-entry permit, they could apply for a 60-day family extension at an immigration office afterwards.

I was in this same position last year. I just asked the officer for visa exempt, he wrote a note in my passport that I requested it and stamped me in for visa exempt.

that is totally gonna be up to the person at passport control you're standing in front of when you go to stamp in.

In theory they don't have to give you a 45 day visa exempt <-(which means you're entering the country AFTER Oct 1st) and they can stamp you in on the valid re-entry permit for the 5 days you have left IF they want to.

Personally I'd wait until the extension/re-entry is expired and THEN enter the country because that way you're sure to get in on a visa exempt stamp.

OR

You can take your chances and if you do get stamped in for the 5 days you have left on the marriage extension you could always go to the immigration office and apply for a 60 day visit thai family extension for 1900baht, that doesn't require any proof of funds.
