TLDR : Answer Summary
The user inquires about the possibility of living in Thailand as they are married to a Thai national and receive a pension that exceeds the required income of 40,000 THB per month, despite not having 400,000 THB in savings. The responses outline two main visa options: applying for a year-long Non-Immigrant Type O Visa based on marriage, which can be done at consulates outside of Thailand without proof of funds, or obtaining a 90-day single entry Non-Immigrant Type O Visa before entering Thailand, followed by applying for a yearly extension of stay. Both options accommodate individuals with sufficient income through pensions or benefits.

Choice two;

Get a 90 day single entry Non-Immigrant Type O visa from a thai consulate before you come (usually around 2000baht). Start transferring a minimum of 40K baht into the country from overseas into a thai bank account in your name only. The transfers MUST show as coming from abroad (they cannot be coded as inside the country transfers).

Go to the immigration office get the hand out that lists the required documentation, copies, photos, etc needed to apply for a year extension of stay based on marriage.

Apply for the yearly extension for 1900baht when you have 30 days or less left on that 90 day stamp you got when you entered the country on a single entry Non-O visa.

The application will go under consideration for 30 days (they usually do an in home visit during this time to make sure you're really married) then on that date you go back to the immigration office and get the year extension inked into your passport.

IF

you are going to leave the country during that year you would also need to buy a reentry permit for 1000baht for a single or 3800baht for a multiple

you can (y) in fact most people on year-long, multi-entry Non-O's get 15 months out of the visa (in 90 day increments) and then that last 3 month stamp they extend by the 60 day visit family extension for 1900baht taking you to 17 months of stay on a visa that lasts a year ;)

Ok thanks for the advice, After my Non-O multi entry has ran out and I exited on the last day it’s finished 30th August can I go to CM immigration and extend for 60 days based on marriage to a Thai.

You can get a 60 day visit family extension on ANY entry stamp for 1900baht.

David Bonar, I'm sorry but I honestly couldn't say how many months of transfers they're gonna wanna see to give you a year extension off a 90 day Non-O entry. I mean you JUST came in on that visa, and even if you started the month you entered you'd only have 2 or maybe 3 months of transfers (I mean how could you know a year ago you were gonna move to thailand and use monthly income method to get an extension of stay based on marriage?)

Good Luck

David Bonar the rule is a minimum of 40K baht transferred from overseas into a thai bank account in your name only each month EVERY month for the preceding 12 months before you apply for your yearly extension <- BUT that is applying for another year OFF of a previous year. It says for the first year there is latitude allowed as far as how many months they want. They WILL want 40K in every month though and you can't skip any months but you can spend as much as you want it's just incoming transfers

David Bonar, to get another year extension you show 12 months BUT to get the initial year extension off a Non-O (the very first year) most offices are allowing you to not show a full year of transfers. That's why I put in there GO to your immigration office.

Take your thai wife, get the hand out that lists everything, talk to them and find out IF choice two is even an option without a full year of transfers.

It's the best information I can tell you, sorry..

Choice one;

Come here on any entry you want to, go to the thai consulate in either Savannakhet Lao or Ho Chi Minh City Vietnam and apply for a year-long, multi-entry Non-Immigrant Type O <-(the O means other) based on marriage to a thai national.

Those two consulates do NOT require proof of funds to issue that visa. That visa is valid for a year from the date it's issued, it is unlimited entry for that year and you get stamped in for 90 days every entry. When your 90 days is running out, you go to the border, stamp out of thailand, stamp in&out of another country and stamp back in to thailand for a new 90 day stamp. You do this for the whole year the visa is valid for taking you to almost 15 months of stay in the country in 90 day increments

In Savannakhet that visa is 5000baht and at HCMC the visa is 200US.

The thing that causes the confusion is the blanket use of b/s terms like "marriage visa" :O

You have a few choices as far as whether you're going to go on year-long Non-Immigrant Type O VISA based on marriage from a thai consulate in another country or whether you want to get 90 day Non-Immigrant Type O visa based on marriage and then apply for a year-long extension of stay inside the country at the immigration office. They are two totally different things that people commonly call a "marriage visa" (although neither is a marriage visa :( )
