TLDR : Answer Summary
The person is inquiring if they can return to Thailand on a Tourist Visa after an extension while simultaneously applying for a Non-O visa based on marriage. They are advised that if it's a Multi Entry Tourist Visa, it remains valid until January 29th. They can return before this date and should get a re-entry permit. If unable to return in time, they should apply for a new Non-O visa in the UK.

One more thing
@Stuart ******
, IF you are going to apply for the 90 day Non-O visa based on marriage to a thai from the immigration office in your area you need to know how many days the application will go under consideration before you go back and get the visa inked into your passport. Most offices require between 21 and 15 days left on your current stamp. SO if your current extension stamp is expiring on the 29th of Jan, you'd need to be back at least by the 8th (if they need 21 days) or the 14th (if they only need 15 days). IF you can't get back by then, just don't worry about the current stamp.

Only you
@Stu***
, know if you can get back IN to the country by the 29th of Jan. IF you can, then get a re-entry permit for 1000 baht and come back.

If you can't, then either buy a NEW tourist visa OR a Non-O based on marriage from the thai consulate in the UK before you come back.

if you are not sure to be back before 29th january, I would say just go and apply for a new Non Immigrant O visa based on marriage when in the UK before coming back to Thailand get the 90 days of stay and apply after 60 days for the Extension of Stay

if you plan to come back with your METV before January 29th, in the hope that you can convert it inside Thailand into a Non-Imm-O based on marriage, you should ask your Immigration if they are willing to do the conversion. Not all Immigration offices will do it

If it is a Multi Entry Tourist visa what you got, it will remain valid for the said period until January 29th. You cannot apply for a new visa in your home country as long as you still hold a valid visa in your passport. You can however start the application process for the Non-Imm-O based on marriage right after midnight of this day, from 30th of January on

you can apply for a new visa from your home country if you still have a valid one in your passport. It just null and voids the one in your passport when you get a new one
