Can I enter Thailand on a tourist visa if I have marriage-related issues and need to stay for 2 months?

Ok, I don't need criticism. But I have been in Thailand for the past 5 years due to being married to a Thai national, multiple O for the 3 years then 2 year marriage extensions, our marriage is over, but she won't divorce me for some reason, I just need to stay here for 2 months, until I sort everything out. Do you think I will be refused entry if I got a tourist visa? I have all my marriage papers, I could easily get a non O because my wife won't divorce me, but I don't want to go down that route. So do you think I could enter Thailand, say by a land border with Laos? Without any problems?

TLDR : Answer Summary
The individual has been living in Thailand for five years due to marriage to a Thai national but is currently in a situation where the marriage is over, and the spouse is not initiating divorce. They are looking to stay in Thailand for an additional two months and are considering whether a tourist visa would be feasible without facing entry issues. Responses suggest getting a tourist visa from an embassy in Laos or Cambodia, or a visa-exempt entry by crossing the border. Alternatives include obtaining a long-term Non-O visa based on the ongoing marital status.

sure, get a tourist visa at the embassy ( laos or cambodia) ( 2 months stay) than extend if u need another 30 days

shouldn't have a problem going to either thai consulate in Lao and getting a single entry tourist visa

OR

go to the border, stamp out of thailand, stamp in and out of lao turn around and stamp back into thailand for a 30 day visa exempt entry

Either of those could workd

IF you wanted to stay another year, seeing as you're still married, and have the documentation, you could just get a year long, multi-entry Non-O visa from the thai consulate in Savannakhet like you used to do? (you said you were on year-multi-Non-O's before)

That visa would be good for as long as it issued and even if you did divorce it wouldn't cancel the visa. You could still bounce in and out every 90 days to for the validity of the visa itself.

So if I got a multi non o and we aren't actually together, it wouldn't cause any problems with immigration? As my wife is very good at blackmailing

@Carl *******
nope, wouldn't cause a problem at all, EVEN if you got divorced after you got the visa issued wouldn't make the visa invalid. You met the requirements when you bought the visa and it's good for exit/entry as long as it's valid for even if the reason you got it changed.

It's not like an extension of stay inside the country that IF the reason you got the extension changes you have to go cancel it (like if you got divorced).

A year-multi-VISA and a year extension are two totally different things and handled differently.

you could get 15 months of stay out of a year-multi-Non-O just like before whether you're with your wife or not or whether you divorce or not

One more thing, do I have to cancel my marriage extension before I leave the country?
Tod *********
@Carl *******
if you don't have a re-entry permit when you stamp out you'll be fine.

If you do have a re-entry permit you still most likely will be fine

BUT

officially you should cancel it at your immigration office and then leave.

most people don't and they don't have issues though

You are 100% correct

when applying for a yearly extension of stay based on marriage at the immigration offices inside the country. They want the reason for your extension (your wife) to be there with you (y)
