I need to convert my Non B Visa to a Non O marriage Visa. My current Non B is valid until mid June. My teaching job ends in March. At that time I’ll stop teaching. Can I covert it (have the 400k baht in the bank now) as soon as my job ends or do I need a letter as well from my employer stating my work permit and Non B are no longer required, that’s why am getting the O Visa.

TLDR : Answer Summary
The process to convert a Non B Visa to a Non O marriage Visa can be done after you stop working, but it is advisable to inform your employer and obtain a letter confirming that your work permit and Non B Visa are no longer required. You do not need to change your Visa category if you have been extending your stay based on your employment. You can change the reason for your extension of stay to marriage without applying for a new visa.

You get the documentation from your employer stating you're canceling your employment extension on xxx date, AND you have all the documentation ready to apply for a yearly extension based on marriage (that you can get from the immigration office as a hand out) THen you go to the immigration office, cancel your extension of stay based on employment, and immediately apply for a new yearly extension based on marriage to a thai by meeting the requirements for that extension . It will go under consideration for 30 days then you go back and get the year inked into your passport.

Now to get a yearly extension of stay based on marriage to a thai you don't need to get a Non-O visa :O you only need to have HAD a Non-Immigrant Type visa in the past that you're getting extensions from now. Which you did, you had a Non-B and now you've been getting yearly extensions based on employment from it.

All you really need to do is change the REASON for your extension from one based on employment, to one based on marriage to a thai.

You get documentation from your employer stating that they know and have no problem with you canceling your extension based on employment and getting one based on marriage to a thai.

, okay, the problem with your question IS that it starts out using the wrong terminology and that runs the answers off the rail :O

You DON'T have ANY visa anymore and as long as you've been getting yearly extensions from the immigration office you haven't. You originally did have a Non-B BUT before it expired you applied for a year extension of stay based on employment and you seem to say you've been on them since that time, year after year.

I have been here for 5 years. I have been getting my non b extended for 5 years.

Wouldn't it be a lot simpler to change the reason for your extension of stay to marriage now (assuming your funds are seasoned) then come march all you need to do is cancel your work permit. No need for a new visa, no need to leave the country.

I have a non b now and I’m in country

So the visa remains a B visa?

Then you should be able to simply change the reason for your extension from working to married without any need to obtain a fresh visa. The work permit you'll need to cancel.

@Jon *******
are you on a visa currently or on an extension of stay based on a previous visa? If it's the latter you don't need to get a non-o visa, you can simply change the reason for your extension of stay

I will not be eligible to extend the Non B as I am stopping working so why do you suggest I extend it?

I am not familiar with Khon Kaen, but as a general rule, you do not have to change your Visa status (from B to O) -- To extend your stay for being married to a Thai, the rule requires you entered on a Non-Immigrant Visa, but does not stipulate any particular category. So, you should be able to simply change your reason for applying for an extension of stay from business to marriage.

To originally receive the Non B, you needed documentation from employer it was issued by an Embassy/Consulate outside of Thailand and was valid for initial "entry" into Thailand. Upon entry, Immigration gave you a permission to stay of 90 days, which they give for the majority of Non-Immigrant Visas regardless of category (B, O, etc.). To remain in Thailand, you would have applied for an extension of that stay at Thai Immigration for the purpose of teaching (work), which also required a Work Permit. The extensions could be renewed for that purpose so long as you continued to work and hold a work permit. The Immigration Rules for granting an extension of stay based on marriage requires you entered on a Non Immigrant Visa - it can be "O" or a "B" or some other category. I would suggest you check with your local Immigration Office to see if they will accept it for a marriage extension without the need for changing your Visa category.

Better to state which immigration office in Thailand you are using? possibility and requirements varies depending on the immigration office.
