Can I Apply for a Type-O Spousal Visa in Thailand if My Thai Wife is Abroad?

Question regarding marriage/type-o immigration visa for Self-Employed individuals:

Hi there, I'm currently on an METV visa on my second entry in Thailand. My wife is Thai, she's currently stuck in Norway (and I'm from Canada, she can't go there and I cannot go to Norway right now). I was not anticipating to stay in Thailand past May this year, but it's looking like plans are changing.

I am looking to apply for the Type-O spousal visa in Thailand, but I have a couple questions for anybody who can shed some light. Does my wife need to be in Thailand to apply for this visa? Secondly, we do not yet have 400k in a Thai bank account. We could make this happen, but from what I've read, the money needs to have been in the account for >2months prior to the application which leaves this one out. This leaves me with the option of proving I make at least 40k/baht per month. As a self-employed individual, how do we go about proving this other than tax/bank statements? Will the Canadian embassy provide such documentation, and would I have to physically appear at the Canadian embassy in Bangkok? (I'm Currently in CM)

Lastly, I still do have the option of returning to Canada, but I would greatly prefer to be here for my wife if she can no longer stay in Norway (she has been layed off from both of her jobs). Any information would be very much appreciated!

you need between 15 and 21 days left on your current entry stamp (off a 30 day visa exempt, a 60 day tourist visa or an extension from one of those) to apply for an in country 90 day non-O visa because the application goes under consideration for a period of time before you go back and get the Non-O visa and the 90 day stamped inked in.

Once your wife gets back you could apply for a 60 day visit thai family extension at the immigration office (to buy you more time so you can apply for the Non-O).

Keep in mind NOT every immigration office offers the in country conversion so check with your office to see if it can be done.

As far as proof of funds the 400K baht has to be in a thai bank account in your name only and you need to prove it was transferred in from abroad. The seasoning of the money for the 2 months is ONLY after you get the 90 day non-O and are applying for a year extension

GO to the immigration office when you wife gets back and see what your options are there.

Hey, is there a way to contact the Thai immigration here regarding marriage visas? It turns out my wife will likely be returning to Thailand pending what happens on April 12th in Norway, which I assume will be an extended shutdown of the country. She cannot continue to pay for rent in Norway alone after this month. We did register our marriage in Ubon Ratchatani when she was here during her internship at Lanna International, and both of our names are on the lease of this apartment. However, I fear that between travel time and her having to be in mandatory quarantine for 14 days, we would not be together until just a few days short of when my current entry expires (and my METV expires 4 days before my entry expires - on May 3rd). I was wondering if it's possible to apply for a non-immigration visa within TH prior to her arrival, and then convert that into a marriage visa once she has arrived? Or something of the like.

Depending on the immigration office they require between 15 and 21 days left on your current 30 day visa exempt entry, 60 day tourist visa entry OR a 30 day extension from one of those to apply for the in country 90 day Non-O visa based on marriage to a thai.

That's because the application goes under consideration for between 14 and 20 days before you go back and get the Non-O visa and a new 90 day entry stamp inked into your passport.

Do you file tax returns in Canada? As such your NOA ( notice of assessment) could be used to support your income. Not sure if the embassy in Bangkok could validate but you could ask them

RIght Canada DOES issue the affidavit of income from abroad notary letters AND the immigration office DOES accept those letters.

I didn't put that in because his thai wife <- the reason he's applying for the visa in the first place isn't here :(

you will not get an in country Non-O visa based on marriage to a thai without your thai wife here. That's not an option.
