Can I Apply for a Non-O Visa from Canada if I Have a Thai Spouse?

Question around the non O Visa

I am Canadian ,over 50, with a Thai spouse. She owns a home in Thailand. I presently hold a non b visa with wp which expires on March 31 ,2020. I do not plan to renew . Can I apply for a non O in my home country? Thank you.

You wouldn't need a NEW Non-O visa at all, you already have an extension based on employment and on having held a Non-B visa.

What you could do is, get paperwork from your employer stating you will stop on xxx date, get all the documentation required to get a yearly extension based on marriage, go to the immigration office, cancel your extension based on employment and immediately apply for a new yearly extension based on marriage without leaving the country.

No plans to continue teaching, just wish to apply for non o ,not non o-a

if you keep on teaching you need the Extension of Stay based on working or based on being married to a Thai National in combination with the Work Permit. The basis of being over 50 years does not allow you to work. Same if you choose to get a new visa in Canada, only the Non Immigrant B or Non Immigrant O based on being married with a Thai National can be used in combination with the Work Permit.

I had five work perments from three labour offices while I was on an extension of a non O, on each extension it was clearly stamped RETIREMENT, but there was never a stamp employment prohibited.

Before this Extension of Stay ends you can apply for a new Extension of Stay based on being over 50 years of age or based on being married to a Thai National. No need to go to Canada to apply first for a new visa

you use the non immigrant b visa and make every 90 days border runs? Or do you have the 1 year Extension of Stay stamp from Immigration and report there every 90 days?
