Hello. I am currently on a non-O multiple entry visa based on marriage to a Thai (issued before Savannahkhet changed the requirements regarding 400K in the bank). My question is, if I want to apply for a 1-year extension using the 40K per month income method, can I do that before my current visa expires or do I first have to extend using 400K in the bank and then after a year switch to the monthly income method. I'm unclear on this. Thank you.

TLDR : Answer Summary
The individual can apply for a 1-year extension on their Non-O visa using the 40K baht per month income method, but they must provide evidence of 12 months of 40K baht transfers into their Thai bank account before applying for the extension. They do not need to wait for their current visa to expire and can apply at any point during their 90-day stay.

As you work inside Thailand you only have to show your tax and sso payments of the last 3 months from you and the Thai staff needed to get the work permit.

You can apply during every 90 day of stay you got on entry with this visa and do not have to wait until the visa itself expires

Because you already have a Non-O visa you would have to show 12 months of 40K baht a month incoming transfers into a thai bank account in your name only before you could apply for the year extension.

So you'd have to use the year-long, multi-entry Non-O visa the entire year (bouncing out and back every 90 days)

AND

at the same time transfer in 40K baht month, each month every month for the previous 12 months

I have been going in and out every 90 days so far. I got it in May 2024 and have left in August and November so far and will going out again in February. So, I think that part is OK. Can I use my Thai tax return to show 40K average a month in income since I am working here in Thailand? Some of the 40K comes from my government school teaching position and some comes from teaching Myanmar students online. Any idea if this is acceptable if I have pay slips, matching deposits in my Thai bank account, and it's also claimed on my Thai tax return? Thank you.

it ALL has to come from legally working inside thailand, <- as the monthly salary has to be 40K so if the online teaching is taxed inside thailand you should be fine and as rober said you'd only need 3 months of proof of income..

Sorry I didn't realize you were legally working inside the country, so disregard the "transfer 40K baht a month into the country to your thai bank account" part. ..

you can apply for the year extension when you have 30 days or less left on ANY of the 90 day entries off this Non-O visa,

Before you decide to do it go to your immigration office and show them the income slips to make sure it'll fly and to get the hand out listing the requirements

thank you for the information. About 80 percent of the 40K would come from my Thai salary and the rest from teaching online. That online teaching income is claimed on my Thai return and I pay tax on it if that makes a difference.

might work then, you'd have to show immigrations the tax documents required to use income from legally working here and see what they say but if it's over the threshold and paid as you said should work

for the 40k baht a month 'income method' are you talking about you legally working here in thailand on a salaray of 40k baht a month

OR

are you talking about transferring IN to the country from abroad a minimum of 40K baht a month ?

some of the month comes from legally working here with a work permit at a government school and some come from online teaching Myanmar students. That money is transferred to my Thai bank account. Not tutoring Thai students. An actual language school that is based in Myanmar but also has a Thai location in Bangkok. But the money is from Myanmar student, so I am guessing it's foreign earned income?

GO talk to the immigration office to see if you can use that income. If it's comin' from overseas it's not money earned legally working inside thailand or that' how I'd interpret it
