Had our visas approved today however, we had a caveat on our application requirements which were concerned now means our children can’t enrol at any school whilst in Thailand? Is this the case or can they enrol in a student visa or similar should they wish to enrol? Anyone had this or similar?

“A consent letter from your parent to acknowledge and understand that holders of DTV including principal DTV holder and all dependants are not permitted to undertake or participate in formal education programmes in Thailand under this visa category.”
Answer summary
The original post raises a concern about restrictions on children's education under a specific visa category (DTV). The visa implies that neither the principal holder nor dependents can participate in formal education in Thailand. Comments discuss the implications of this restriction and suggest that while the DTV visa comes with certain limitations, alternatives like a student visa for children are possible if they wish to enroll in school. Users also share their experiences and opinions about the different types of visas, highlighting the nuances and frustrations faced by expats in navigating these systems.

While dissecting this ....

It would seem the Embassy issued a 90 day ED visa which will likely not be able to be extended, unless the school somehow meets the ministry qualifications.

The embassy obviously felt that the application did not meet the requirements for DTV.

This is a bit of a "gift" 90 day visa, the IO were right to question it as per your intention.

In the end they opted to give you the 90 days anyway.

This is how I would interpret it.

Better than tourist 60 day or rejection.

We had this from Tokyo but it turned out to be a massive problem as if the gym is not a recognized school under the education authority ( most are not) then the ed visa is technically illegal as the gym cant conform to any of the requirements and compliance for the education visa. They really shouldnt do thst

Tokyo is garbage for this. They gave me an education visa shorter and the wrong time, it ends before my school even starts.

So you decided to tell a government employee that has decision making power and you never met before that you think other government employees are bad and told them another government agency rejected you? This seems really odd and not common sense. Furthermore, you just stated that you were issued an ED visa, even if you didn’t want it, so technically you do have a valid visa, and they were asking for it. Why not just hand the ED visa over, get stamped in and then find an agent to help you? You cant apply for the DTV until the ED expires or is canceled anyway. How long is it good for? Was it single entry? If so, you probably should have entered on it and then when you left to apply again for the DTV, it would be expired (if single entry). Also, what course can you not do with your current ED visa? You sure they were not concerned about you being sketchy? This will not stay on your file, if this is even a true story
BravePers*********

DTV_BegPecker the school started in November, the ed visa lasted 2 months and expires before it even starts, it's common sense, hence the explanation
DTV_Be*******
DTV_Be*******
BravePersimmon1025 Sorry, this is not common sense. Why would you apply for a soft power DTV in June for a course that starts in November? That is like half a year away. They don’t have a course starting earlier?
Anonymous ******************
Anonymous ******************
DTV_BegPecker actually that could possibly be a factor, since the e-visa website does say apply within 3 months of intended travel, so I wonder what travel date the op applied with. Was never detailed.

education visa is not a downgrade compared to DTV which is only a tourist visa.

Incorrect statement by yourself. Non-O extensions can be obtained remotely via Visa Agents with no need for the holder to attend immigration office.

@Luit ****************
Once again, you've hit this stumbling block of what you don't know and what you believe is officially allowed. One is embarassing for you and the other incorrect. Try Thai Visa Centre for confirmation of what goes on in reality.

@Christopher **********
Funding satisfied by agent is also illegal, but sending passport while I am not in the country is a bit tricky don't you think?

You are just suggesting al kind of illegal options, and when I tell those options are not legal you accuse me of being incorrect informed.

I would have welcomed a legal option to extend while not in the country, but what you suggest is just not legal.
Christopher ***********
Christopher ***********
@Luit ****************
To obtain a Non-O extension you need one visit to your local Post Office. You need an active Thai bank account although the funding requirement is satisfied by the agent. You send your passport plus four passport style photographs. You take a selfie and send the image file to the agent either via LINE or as an email attachment. Fee payable on website. You receive your passport by post with extension stamp. Agent can provide re-entry permits and Certificate of Residence too if/when necessary.
Luit *****************
Luit *****************
@Christopher **********
I certainly not accept it happens. In fact I opened a topic and asked and since the stamp for extension needs to be in the passport it is even impossible.

I did not base my decision on wrong info, you are just the only one telling it should be possible, but don't come up with proof.

Why should I complain at Immigration?
Christopher ***********
Christopher ***********
@Luit ****************
You accept that remote Non-O extensions via Visa Agents are happening. If it is your personal belief that they shouldn’t be then you must complain to the Visa Agents who advertise them and to the Thai Immigration Bureau who issue them. It appears you’ve based your decision on which visa to apply for based upon incorrect information. You should have verified what was actually possible by digging deeper before deciding.
Luit *****************
Luit *****************
@Christopher **********
Just prove your statement, nothing at all indicates you are right.

Why do you think a lot of non-o visa holders switch to DTV just because they don't like the visits to the immigration office.

You are talking complete BS here yourself, and it looks like your only goal on this group is to annoy others by insulting, spreading misinformation, and encourage people to act illegal.

If your claim were true, you could easily indicate where that is described, and you wouldn't have to endlessly whine that others don't have the correct information.
Christopher ***********
Christopher ***********
@Luit ****************
In summary, you don’t know what’s right from wrong. You only know what an immigration officer told you. Was he the same officer who told you that for a DTV to remain valid, the conditions fulfilled for application must continue for the life of the DTV? That, of course, isn’t true. You already know AI and Google searches pull up out-of-date information, troll posts plus plain wrong from the start details. The more options available the better. Only trolls seek to try to discredit, cause unease, set people up for a fail and make life more difficult for others.
Christopher ***********
Christopher ***********
Luit van der Linde How do you know what is 'offically allowed'? Have you access to a regulation that states an extension applicant must be physically present in the immigration office? How does it affect you? Why do you care? If you are sure of your grounds then as a concerned visa holder yourself you should be warning others that their extensions thus obtained must be invalid. There will be implications for extension holders, Visa Agents and the Immigration Office concerned. Are you confident enough to go down that route? Otherwise your statements are mischief and could be construed as trolling.

I've lived here on 1 year extensions for many years and now I live here with DTV for next 4 years with zero obligations apart from going somewhere for a couple days holiday every 6 months, 100% an upgrade for me
Luit *****************
Luit *****************
FascinatingShark6516 You need a remote job for the next years or a soft power activity, but as long as you don't see that as obligations, it is OK.

Apart from the fixed scheme of extend every year in person, the non-o does not have obligationa that you don't have on DTV.

Luit *****************

At entry IO also can check if your pupose of visit matches your visa, recently they started paying more attention to this for all kind of visa.
Christopher ***********
Christopher ***********
Luit van der Linde Neither remote working nor enrolment/participation in a soft power course/activity is necessary once your DTV has been issued. I don’t know what makes you believe that extensions can only be obtained ‘in person’?
Luit *****************
Luit *****************
FascinatingShark6516 Then the big question is if it will be possible to use the visa without its purpose of stay for 5 years.

@Luit ****************
it's still speculation. Due to unwritten rules of the DTV visa. NOT surprising.
Luit *****************
Luit *****************
@James *******
That depends on what you see as unwritten.

IO can check if purpose of visit matches visa.

I know some people here say that when having a proper employment contract at the moment of application, it is not really necessary to have such a job anymore at the moment you enter Thailand and some here auggest you only need that job on paper, not in real life.

That is a way to look at the law describing visa requirements, but not necessary the interpretation Immigratiion or a judge might use.

those obligations are " unwritten " at this time.

DTV is an upgrade on most , I upgraded to DTV from non O 1 year extensions. It's definitely an upgrade for me no question
Luit *****************
Luit *****************
FascinatingShark6516 A tourist visa only for specific purposes with the obligation to leave the country at regular intervals is normally not seen as an upgrade compared to a visa without these obligations.

Only when you have to do remote work that makes any sense.

it's totally a downgrade. With the DTV you're free to do whatever you want, with an ED, skip a few classes and you'll get it canceled. You can't enter and exit the kingdom anytime either, unlike with the DTV. And even for the bank-lovers, you can't open an account with an ED visa either now, only with the ED+ for university students.

Not to mention the DTV is good for five full years (maybe even 5 and a half).
Luit *****************
Luit *****************
@Elías *******
For people who see ED not as a visa to study, but just as an excuse to stay in the country, DTV might be seen as an upgrade, at least until they will stop that creative use on DTV too, just like they did on ED.

i would definitely call it a downgrade. you need to run to immigration every 3 months and also some school ministry. annoying. compared to the DTV where you literally never need to go to immigration (besides border entry) for 5 years… it is such a relief coming from ED to DTV. finally you are not on a timer that is pressuring you. huge difference… call it tourist visa of you want. doesnt change what has been said
ExcitingR**********
ExcitingR**********
It’s only a downgrade if your intent is to abuse the visa. Like many did in the past. Which triggered a clamp down on this visa by immigration . Was epic. It’s a cycle. When abuses will be too much and too obvious, DTV will face a clamp down the same way ED did .
Christopher ***********
Christopher ***********
ExcitingRaccoon1731 Easy to comply with DTV requirements. Once it’s issued there are only two; 1) Either extend or exit at 180 days and 2) Exit after 360. What exactly are the ‘too much and too obvious abuses’ to which you refer?
Sujy *********
Sujy *********
They were concerned because ED Visa has a very bad rep due to many people not going to school. You literally told them that you would not go... never do that again please. Make anything up but do not tell them that your visa doesn't match why you are entering. Keep the same story but tell them that you are going to school.
Andi ***********
Andi ***********
It's good you could enter. What course did you apply for with Tokyo? They are very strict and often downgrade if they are not satisfied an application meets the need for a 5 year visa.
