Will my Non-B visa be cancelled when my work permit is cancelled, and how can I convert it to a spouse visa in Thailand?

Hi,

I’m coming up to the end of my job and will have work permit (BOI) cancelled around the 1st of next month. So wondered if my non b will be cancelled the same day?

I am married to Thai and have a child and will be looking to convert the non b to a spouse visa. Is there any recommendations regarding companies anyone has used before to do this without having to fly out-in?

As BOI they will do cancellation both of your extension and WP at One Stop Service at Chumchuri Square (if in Bangkok). But you need to go to immigration office in Chaengwattana for your extension based on marriage..

Likely they will give you 7 to 21 days to leave the country, but this is not extension anymore. Not all the immigration office let you apply another extension during this no-more-extension period. Someone couldn't do in Bangkok to change the reason for extension within this period.

If you want to get extension for different reason, better not get those grace days and need to go to immigration office same day on your cancellation or earlier if your employer can arrange those in advance.

I did this 3 years ago from non-b to non-o based on marriage, although not BOI my company was under the one stop service at Charmchuri Square. I actually used the agent/lawyer that my company was using to do the process and paid them personally to handle the switch. You can do it yourself but you will spend quite a bit of time. if you have more important things to do, any law firm dealing with visas will be able to handle it for you, just have to find one that doesn't charge too much 😁

if that includes the official fees and all expenses of the agent it's not too bad, you will also need the re-entry if you travel a lot, 3,800 THB for multiple if I remember correctly

When my WP was cancelled some 6 years ago now, I went to immigration the next day to change from Non Imm B to O on retirement. I had a warning so all my documents were correct. Nevertheless I was charged 2 days ov erstay - the day my WP was cancelled and the next day when I went to Imm. Go figure! Just a heads up.

it’s an Immigration rule that when you cancel your wp then you also have to cancel your visa, as the visa status is connected to your wp. Basically, you’re supposed to leave the country (within 7 days) when your work is over.

Since I was late, I was advised to fly out, get a tourist visa, and come back and cancel my visa connected to my wp - and pay the overstay.

Visas can't be canceled to my knowledge. How should have your employer cancel the visa?

Yes, go the same day. My employer cancelled my wp without cancelling my visa - told me that I could stay until my visa ran out....Since I didnt know, I ended up having 88 days overstay😱 Your employer can ask for a 7 day extension and maybe more if they give a good reason (kids in school or something).

Why pay an agent to hold your hand, you can do the walk yourself. Hand over the blue booklet with letter from company to the Ministry of Labor and just ask to cancel. Wait for their documents and take that with passport to Immigration and ask can you cancel my Extension of Stay. That is all.

I was told it may be worth using an agent. Going with my company to cancel the wp then meet the agent the same day and head for immigration...thanks for the advice 👍

but you did not work for a company connected to the Board of Investment, who has a one stop service office, including Immigration and Ministry of labor in Bangkok.

If you have all the documents supplied by the BOI office, you should contact them directly as they have some special agreements and can help you to apply for other visa.

my HR will deal with cancelling of the wp so have said they will request this if that is possible for a week. I have little faith in them however so thought best to get advice here
